55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to background and criminal history checks for operators
88 and employees of certain child-care facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 42.159, Human Resources Code, is amended
1111 by adding Subsections (b-1), (b-2), and (c-1) to read as follows:
1212 (b-1) A person subject to the background and criminal
1313 history check required by Subsection (a) or (b) shall submit to the
1414 commission a complete set of fingerprints.
1515 (b-2) The executive commissioner shall adopt rules to
1616 implement this section. The rules adopted under this section:
1717 (1) must require that the fingerprints submitted be in
1818 a form and of a quality acceptable to the Department of Public
1919 Safety and the Federal Bureau of Investigation for the purpose of
2020 conducting a criminal history check;
2121 (2) may require that the fingerprints be submitted
2222 electronically through an applicant fingerprinting service center;
2323 and
2424 (3) may allow the commission to waive a fingerprint
2525 submission required by this section if:
2626 (A) the person for whom the submission is
2727 required has:
2828 (i) a fingerprint-based criminal history
2929 check on file with the commission; or
3030 (ii) a fingerprint-based criminal history
3131 clearinghouse record, as provided by Section 411.0845, Government
3232 Code, that is accessible to the commission through the Department
3333 of Public Safety; and
3434 (B) the commission has an active subscription to
3535 the Federal Bureau of Investigation's National Record of Arrest and
3636 Prosecution Back Service for the person for whom the fingerprint
3737 submission is required.
3838 (c-1) For each person whose fingerprints are submitted
3939 under Subsection (b-1), the department shall conduct a state and
4040 Federal Bureau of Investigation criminal history check by:
4141 (1) submitting the person's fingerprints, or causing
4242 the fingerprints to be submitted electronically, to the Department
4343 of Public Safety for the purpose of conducting a state and federal
4444 criminal history check; and
4545 (2) using the resulting information made available by
4646 that department under Section 411.114, Government Code, and by the
4747 Federal Bureau of Investigation and any other criminal justice
4848 agency under Section 411.087, Government Code.
4949 SECTION 2. Section 42.206, Human Resources Code, is amended
5050 by amending Subsection (b) and adding Subsections (b-1) and (c-1)
5151 to read as follows:
5252 (b) In addition to the requirements of Subsection (a), a
5353 shelter shall submit a complete set of fingerprints of each person
5454 required to undergo a criminal history check under Subsection (a)
5555 [if:
5656 [(1) the person has lived outside the state at any time
5757 during the previous five years; or
5858 [(2) the shelter has reason to suspect that the person
5959 has a criminal history in another state].
6060 (b-1) The executive commissioner shall adopt rules to
6161 implement this section. The rules adopted under this section:
6262 (1) must require that the fingerprints submitted be in
6363 a form and of a quality acceptable to the Department of Public
6464 Safety and the Federal Bureau of Investigation for purposes of
6565 conducting a criminal history check;
6666 (2) may require that the fingerprints be submitted
6767 electronically through an applicant fingerprinting service center;
6868 and
6969 (3) may allow the commission to waive a fingerprint
7070 submission required by this section if:
7171 (A) the person for whom the submission is
7272 required has:
7373 (i) a fingerprint-based criminal history
7474 check on file with the commission; or
7575 (ii) a fingerprint-based criminal history
7676 clearinghouse record, as provided by Section 411.0845, Government
7777 Code, that is accessible to the commission through the Department
7878 of Public Safety; and
7979 (B) the commission has an active subscription to
8080 the Federal Bureau of Investigation's National Record of Arrest and
8181 Prosecution Back Service for the person for whom the fingerprint
8282 submission is required.
8383 (c-1) For each person whose fingerprints are submitted
8484 under Subsection (b), the department shall conduct a state and
8585 Federal Bureau of Investigation criminal history check by:
8686 (1) submitting the person's fingerprints, or causing
8787 the fingerprints to be submitted electronically, to the Department
8888 of Public Safety for the purpose of conducting a state and federal
8989 criminal history check; and
9090 (2) using the resulting information made available by
9191 that department under Section 411.114, Government Code, and by the
9292 Federal Bureau of Investigation and any other criminal justice
9393 agency under Section 411.087, Government Code.
9494 SECTION 3. This Act takes effect September 1, 2021.
