55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the dissemination of confidential information
88 contained in the juvenile justice information system.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 58.106(a), Family Code, is amended to
1111 read as follows:
1212 (a) Except as otherwise provided by this section,
1313 information contained in the juvenile justice information system is
1414 confidential information for the use of the department and may not
1515 be disseminated by the department except:
1616 (1) with the permission of the juvenile offender, to
1717 military personnel of this state or the United States;
1818 (2) to a criminal justice agency as defined by Section
1919 411.082, Government Code;
2020 (3) to a noncriminal justice agency authorized by
2121 federal statute or federal executive order to receive juvenile
2222 justice record information;
2323 (4) to a juvenile justice agency;
2424 (5) to the Texas Juvenile Justice Department;
2525 (6) to the office of independent ombudsman of the
2626 Texas Juvenile Justice Department;
2727 (7) to a district, county, justice, or municipal court
2828 exercising jurisdiction over a juvenile; and
2929 (8) to the Department of Family and Protective
3030 Services or the Health and Human Services Commission as provided by
3131 Section 411.114, Government Code.
3232 SECTION 2. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2021.
