9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 58.106(a), Family Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | (a) Except as otherwise provided by this section, |
---|
13 | 13 | | information contained in the juvenile justice information system is |
---|
14 | 14 | | confidential information for the use of the department and may not |
---|
15 | 15 | | be disseminated by the department except: |
---|
16 | 16 | | (1) with the permission of the juvenile offender, to |
---|
17 | 17 | | military personnel of this state or the United States; |
---|
18 | 18 | | (2) to a criminal justice agency as defined by Section |
---|
19 | 19 | | 411.082, Government Code; |
---|
20 | 20 | | (3) to a noncriminal justice agency authorized by |
---|
21 | 21 | | federal statute or federal executive order to receive juvenile |
---|
22 | 22 | | justice record information; |
---|
23 | 23 | | (4) to a juvenile justice agency; |
---|
24 | 24 | | (5) to the Texas Juvenile Justice Department; |
---|
25 | 25 | | (6) to the office of independent ombudsman of the |
---|
26 | 26 | | Texas Juvenile Justice Department; |
---|
27 | 27 | | (7) to a district, county, justice, or municipal court |
---|
28 | 28 | | exercising jurisdiction over a juvenile; and |
---|
29 | 29 | | (8) to the Department of Family and Protective |
---|
30 | 30 | | Services or the Health and Human Services Commission as provided by |
---|
31 | 31 | | Section 411.114, Government Code. |
---|
32 | 32 | | SECTION 2. This Act takes effect immediately if it receives |
---|
33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
---|
34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
---|
36 | 36 | | Act takes effect September 1, 2021. |
