66 AN ACT
77 relating to the criminal punishment and conditions of community
88 supervision for the offense of obstructing a highway or other
99 passageway; increasing a criminal penalty.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter K, Chapter 42A, Code of Criminal
1212 Procedure, is amended by adding Article 42A.517 to read as follows:
1313 Art. 42A.517. COMMUNITY SUPERVISION FOR CERTAIN OFFENSES
1414 INVOLVING OBSTRUCTION OF HIGHWAY OR OTHER PASSAGEWAY. A court
1515 granting community supervision to a defendant convicted of an
1616 offense punishable as a state jail felony under Section 42.03,
1717 Penal Code, shall require as a condition of community supervision
1818 that the defendant submit to not less than 10 days of confinement in
1919 a county jail.
2020 SECTION 2. Section 42.03(c), Penal Code, is amended to read
2121 as follows:
2222 (c) An offense under this section is a Class B misdemeanor,
2323 except that the offense is a state jail felony if, in committing the
2424 offense, the actor knowingly:
2525 (1) prevents the passage of an authorized emergency
2626 vehicle, as defined by Section 541.201, Transportation Code, that
2727 is operating the vehicle's emergency audible or visual signals; or
2828 (2) obstructs access to a hospital licensed under
2929 Chapter 241, Health and Safety Code, or other health care facility
3030 that provides emergency medical care, as defined by Section
3131 773.003, Health and Safety Code.
3232 SECTION 3. The changes in law made by this Act apply only to
3333 an offense committed on or after the effective date of this Act. An
3434 offense committed before the effective date of this Act is governed
3535 by the law in effect when the offense was committed, and the former
3636 law is continued in effect for that purpose. For purposes of this
3737 section, an offense was committed before the effective date of this
3838 Act if any element of the offense occurred before that date.
3939 SECTION 4. This Act takes effect September 1, 2021.
