| 7 | 7 | | relating to gubernatorial appointments to the board of directors of |

| 8 | 8 | | certain regional mobility authorities. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 370.251(a), Transportation Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a) Except as provided by Subsection (a-1), the governing |
|---|
| 13 | 13 | | body of an authority is a board of directors consisting of |
|---|
| 14 | 14 | | representatives of each county in which a transportation project of |
|---|
| 15 | 15 | | the authority is located or is proposed to be located. The |
|---|
| 16 | 16 | | commissioners court of each county that initially forms the |
|---|
| 17 | 17 | | authority shall appoint at least two directors to the |
|---|
| 18 | 18 | | board. Additional directors may be appointed to the board at the |
|---|
| 19 | 19 | | time of initial formation by agreement of the counties creating the |
|---|
| 20 | 20 | | authority to ensure fair representation of political subdivisions |
|---|
| 21 | 21 | | in the counties of the authority that will be affected by a |
|---|
| 22 | 22 | | transportation project of the authority, provided that the number |
|---|
| 23 | 23 | | of directors must be an odd number. The commissioners court of a |
|---|
| 24 | 24 | | county that is subsequently added to the authority shall appoint at |
|---|
| 25 | 25 | | least one director to the board. The governor shall appoint one |
|---|
| 26 | 26 | | director to the board who shall serve as the presiding officer of |
|---|
| 27 | 27 | | the board and shall appoint an additional director to the board if |
|---|
| 28 | 28 | | an appointment is necessary to maintain an odd number of directors |
|---|
| 29 | 29 | | on the board. For an authority consisting of two or more counties, |
|---|
| 30 | 30 | | each with a population of 400,000 or more, the governor's |
|---|
| 31 | 31 | | appointments shall be made on a rotating basis among the counties in |
|---|
| 32 | 32 | | which a transportation project of the authority is located or is |
|---|
| 33 | 33 | | proposed to be located. |

| 34 | 34 | | SECTION 2. This Act takes effect September 1, 2021. |
