66 AN ACT
77 relating to the expansion of eligibility for Medicaid to certain
88 persons under the federal Patient Protection and Affordable Care
99 Act.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1212 is amended by adding Section 32.02472 to read as follows:
1313 Sec. 32.02472. EXPANDED ELIGIBILITY FOR MEDICAL ASSISTANCE
1414 UNDER PATIENT PROTECTION AND AFFORDABLE CARE ACT. (a)
1515 Notwithstanding any other law, the commission shall provide medical
1616 assistance to all persons who apply for that assistance and for whom
1717 federal matching money is available under the Patient Protection
1818 and Affordable Care Act (Pub. L. No. 111-148), as amended by the
1919 Health Care and Education Reconciliation Act of 2010 (Pub. L. No.
2020 111-152), to provide that assistance.
2121 (b) The executive commissioner shall adopt rules regarding
2222 the provision of medical assistance as required by this section.
2323 SECTION 2. Section 32.02472, Human Resources Code, as added
2424 by this Act, applies only to an initial determination or
2525 recertification of eligibility of a person for medical assistance
2626 under Chapter 32, Human Resources Code, made on or after the date
2727 the section is implemented, regardless of the date the person
2828 applied for that assistance.
2929 SECTION 3. As soon as possible after the effective date of
3030 this Act, the executive commissioner of the Health and Human
3131 Services Commission shall take all necessary actions to expand
3232 eligibility for medical assistance under Chapter 32, Human
3333 Resources Code, in accordance with Section 32.02472, Human
3434 Resources Code, as added by this Act, including notifying
3535 appropriate federal agencies of that expanded eligibility.
3636 SECTION 4. If before implementing any provision of this Act
3737 a state agency determines that any other waiver or authorization
3838 from a federal agency is necessary for implementation of that
3939 provision, the agency affected by the provision shall request the
4040 waiver or authorization and may delay implementing that provision
4141 until the waiver or authorization is granted.
4242 SECTION 5. This Act takes effect September 1, 2021.
