5	5	AN ACT
6	6	relating to academic accountability ratings for certain school
7	7	districts, open-enrollment charter schools, and contracted
8	8	entities that offer full-time online programs through the state
9	9	virtual school network and revocation of approval to operate or
10	10	contract to operate those programs.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Subchapter C, Chapter 30A, Education Code, is
13	13	amended by adding Sections 30A.1011 and 30A.1012 to read as
14	14	follows:
15	15	Sec. 30A.1011. CONTRACTING FOR FULL-TIME ONLINE PROGRAM.
16	16	(a) A school district or open-enrollment charter school that
17	17	contracts with an entity to operate a full-time online program for
18	18	the district or school shall report to the agency:
19	19	(1) the identity of the contracted entity each year
20	20	the contracted entity operates the full-time online program; and
21	21	(2) information required to be reported under Section
22	22	48.008 regarding staff and finances as if the full-time online
23	23	program were a campus.
24	24	(b) A school district or open-enrollment charter school
25	25	shall revoke a contract with an entity to operate a full-time online
26	26	program for the district or school if the entity has received for
27	27	the three most recent school years a campus or district
28	28	accountability rating of D or F under Subchapter C, Chapter 39. A
29	29	school district or open-enrollment charter school shall include a
30	30	contract revocation provision in each contract entered into with an
31	31	entity to operate a full-time online program for the district or
32	32	school under this section.
33	33	(c) The agency shall notify a school district or
34	34	open-enrollment charter school that the district or school is
35	35	subject to Subsection (b) if its full-time online program has
36	36	received for the three most recent school years accountability
37	37	ratings described by that subsection. Failure to receive notice
38	38	under this subsection does not affect the requirement imposed on
39	39	the district or school under Subsection (b).
40	40	(c-1) For purposes of Subsections (b) and (c), an
41	41	accountability rating for a school year before the 2020-2021 school
42	42	year may not be considered. This subsection expires September 1,
43	43	2023.
44	44	(d) A school district or open-enrollment charter school may
45	45	not contract with an entity to operate a full-time online program
46	46	for the district or school if the contracted entity operated a
47	47	full-time online program for a district or school and the
48	48	contracting entity was subject to a contract revocation under
49	49	Subsection (b) within the preceding 10 years.
50	50	(e) The administering authority shall include a list of
51	51	entities subject to a contract revocation under Subsection (b) on
52	52	the state virtual school network Internet website.
53	53	(f) An entity under this section includes a corporate
54	54	affiliate or an entity that is substantially related to the entity.
55	55	(g) The provisions of this section may not be waived by the
56	56	commissioner.
57	57	Sec. 30A.1012. REVOCATION OF APPROVAL FOR FULL-TIME ONLINE
58	58	PROGRAM. If the commissioner revokes approval for a school
59	59	district or open-enrollment charter school to operate a full-time
60	60	online program under this chapter, the district or school may not
61	61	operate a full-time online program under this chapter during the
62	62	10-year period following the revocation.
63	63	SECTION 2. Section 30A.110, Education Code, is amended by
64	64	adding Subsections (d), (d-1), and (d-2) to read as follows:
65	65	(d) An entity that operates a full-time online program shall
66	66	receive an accountability rating under Chapter 39. An entity that
67	67	operates multiple full-time online programs shall receive an
68	68	accountability rating for:
69	69	(1) each full-time online program as if the program
70	70	were a campus; and
71	71	(2) the entity as if the entity were a school district
72	72	or open-enrollment charter school and each full-time online program
73	73	were a campus of the district or school.
74	74	(d-1) This subsection applies only to a school district or
75	75	open-enrollment charter school that provides instruction to
76	76	students while students are located on the physical premises of a
77	77	district or school campus and provides separate instruction to
78	78	students enrolled full-time in courses provided through a district
79	79	or school full-time online program. In determining the performance
80	80	ratings under Section 39.054 of a school district or
81	81	open-enrollment charter school subject to this subsection, the
82	82	commissioner shall evaluate the performance of students enrolled in
83	83	a district or school full-time online program separately from the
84	84	performance of other district or school students and assign:
85	85	(1) separate district or school overall and domain
86	86	performance ratings for the district's or school's full-time online
87	87	program; and
88	88	(2) separate campus overall and domain performance
89	89	ratings for each full-time online program.
90	90	(d-2) Subsection (d-1) and this subsection expire September
91	91	1, 2023.
92	92	SECTION 3. This Act applies beginning with the 2021-2022
93	93	school year.
94	94	SECTION 4. This Act takes effect immediately if it receives
95	95	a vote of two-thirds of all the members elected to each house, as
96	96	provided by Section 39, Article III, Texas Constitution. If this
97	97	Act does not receive the vote necessary for immediate effect, this
98	98	Act takes effect September 1, 2021.
