55 AN ACT
66 relating to academic accountability ratings for certain school
77 districts, open-enrollment charter schools, and contracted
88 entities that offer full-time online programs through the state
99 virtual school network and revocation of approval to operate or
1010 contract to operate those programs.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 30A, Education Code, is
1313 amended by adding Sections 30A.1011 and 30A.1012 to read as
1414 follows:
1515 Sec. 30A.1011. CONTRACTING FOR FULL-TIME ONLINE PROGRAM.
1616 (a) A school district or open-enrollment charter school that
1717 contracts with an entity to operate a full-time online program for
1818 the district or school shall report to the agency:
1919 (1) the identity of the contracted entity each year
2020 the contracted entity operates the full-time online program; and
2121 (2) information required to be reported under Section
2222 48.008 regarding staff and finances as if the full-time online
2323 program were a campus.
2424 (b) A school district or open-enrollment charter school
2525 shall revoke a contract with an entity to operate a full-time online
2626 program for the district or school if the entity has received for
2727 the three most recent school years a campus or district
2828 accountability rating of D or F under Subchapter C, Chapter 39. A
2929 school district or open-enrollment charter school shall include a
3030 contract revocation provision in each contract entered into with an
3131 entity to operate a full-time online program for the district or
3232 school under this section.
3333 (c) The agency shall notify a school district or
3434 open-enrollment charter school that the district or school is
3535 subject to Subsection (b) if its full-time online program has
3636 received for the three most recent school years accountability
3737 ratings described by that subsection. Failure to receive notice
3838 under this subsection does not affect the requirement imposed on
3939 the district or school under Subsection (b).
4040 (c-1) For purposes of Subsections (b) and (c), an
4141 accountability rating for a school year before the 2020-2021 school
4242 year may not be considered. This subsection expires September 1,
4343 2023.
4444 (d) A school district or open-enrollment charter school may
4545 not contract with an entity to operate a full-time online program
4646 for the district or school if the contracted entity operated a
4747 full-time online program for a district or school and the
4848 contracting entity was subject to a contract revocation under
4949 Subsection (b) within the preceding 10 years.
5050 (e) The administering authority shall include a list of
5151 entities subject to a contract revocation under Subsection (b) on
5252 the state virtual school network Internet website.
5353 (f) An entity under this section includes a corporate
5454 affiliate or an entity that is substantially related to the entity.
5555 (g) The provisions of this section may not be waived by the
5656 commissioner.
5757 Sec. 30A.1012. REVOCATION OF APPROVAL FOR FULL-TIME ONLINE
5858 PROGRAM. If the commissioner revokes approval for a school
5959 district or open-enrollment charter school to operate a full-time
6060 online program under this chapter, the district or school may not
6161 operate a full-time online program under this chapter during the
6262 10-year period following the revocation.
6363 SECTION 2. Section 30A.110, Education Code, is amended by
6464 adding Subsections (d), (d-1), and (d-2) to read as follows:
6565 (d) An entity that operates a full-time online program shall
6666 receive an accountability rating under Chapter 39. An entity that
6767 operates multiple full-time online programs shall receive an
6868 accountability rating for:
6969 (1) each full-time online program as if the program
7070 were a campus; and
7171 (2) the entity as if the entity were a school district
7272 or open-enrollment charter school and each full-time online program
7373 were a campus of the district or school.
7474 (d-1) This subsection applies only to a school district or
7575 open-enrollment charter school that provides instruction to
7676 students while students are located on the physical premises of a
7777 district or school campus and provides separate instruction to
7878 students enrolled full-time in courses provided through a district
7979 or school full-time online program. In determining the performance
8080 ratings under Section 39.054 of a school district or
8181 open-enrollment charter school subject to this subsection, the
8282 commissioner shall evaluate the performance of students enrolled in
8383 a district or school full-time online program separately from the
8484 performance of other district or school students and assign:
8585 (1) separate district or school overall and domain
8686 performance ratings for the district's or school's full-time online
8787 program; and
8888 (2) separate campus overall and domain performance
8989 ratings for each full-time online program.
9090 (d-2) Subsection (d-1) and this subsection expire September
9191 1, 2023.
9292 SECTION 3. This Act applies beginning with the 2021-2022
9393 school year.
9494 SECTION 4. This Act takes effect immediately if it receives
9595 a vote of two-thirds of all the members elected to each house, as
9696 provided by Section 39, Article III, Texas Constitution. If this
9797 Act does not receive the vote necessary for immediate effect, this
9898 Act takes effect September 1, 2021.
