66 relating to the right of certain hospital patients to designate an
77 essential caregiver for in-person visitation.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subtitle B, Title 4, Health and Safety Code is
1010 amended by adding Chapter 241(B) to read as follows:
1111 CHAPTER 241B. RIGHT TO ESSENTIAL CAREGIVER VISITS FOR CERTAIN
1212 HOSPITAL PATIENTS
1313 Sec. 241B.0001. DEFINITIONS. In this chapter:
1414 (1) "Essential caregiver" means a family member,
1515 friend, or other individual selected by a facility patient for
1616 in-person visits.
1717 (2) "Executive commissioner" means the executive
1818 commissioner of the Health and Human Services Commission.
1919 (3) "Hospital" includes general hospital and special
2020 hospital licensed under Chapter 241.
2121 (4) "Patient" means a person who, to receive medical
2222 care, consults with or is seen by a physician.
2323 (5) "Child" or "Minor" means a person under 18 years of
2424 age who is not and has not been married or who has not had the
2525 disabilities of minority removed for general purposes.
2626 (6) "Parent" has the meaning assigned under Section
2727 101.024, Family Code.
2828 Sec. 241B.0002 PATIENT'S RIGHT TO ESSENTIAL CAREGIVER
2929 VISITS. (a) A hospital patient has the right to designate at least
3030 one essential caregiver with whom the hospital may not prohibit
3131 in-person visitation.
3232 (b) In the case of a patient who is a minor, the hospital must
3333 designate as an essential caregiver:
3434 (1) any parent that has not had their rights limited by
3535 a court; and
3636 (2) any person with conservatorship over the minor that
3737 has not been limited by a court.
3838 (c) Notwithstanding Subsections (a) and (b), the executive
3939 commissioner by rule shall develop guidelines to assist hospitals
4040 in establishing essential caregiver visitation policies and
4141 procedures. The guidelines must require hospitals to:
4242 (1) allow patients to designate for in-person
4343 visitation at least one essential caregiver, and more than one if
4444 needed;
4545 (2) establish a visitation schedule allowing the
4646 essential caregiver to visit the patient for the greater of two
4747 hours each day or the hours necessary for the caregiver to complete
4848 all caregiving tasks;
4949 (3) establish procedures to enable personal contact
5050 between the patient and essential caregiver;
5151 (4) obtain a signed acknowledgment from the essential
5252 caregiver in which the caregiver agrees to follow the hospital's
5353 safety protocols.
5454 (d) In the event of a conflict between this section and any
5555 other law, this section prevails.
5656 SECTION 2. As soon as practicable after the effective date of
5757 this Act, the executive commissioner of the Health and Human
5858 Services Commission shall establish the guidelines required by
5959 Sections 241B.0002, Health and Safety Code, as added by the Act.
6060 SECTION 4. This Act takes effect September 1, 2021.
