66 AN ACT
77 relating to the continuation of the MEDCARES grant program and
88 transfer of the oversight and administration of the program from
99 the Department of State Health Services to the Health and Human
1010 Services Commission.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter F, Chapter 1001, Health and Safety
1313 Code is hereby repealed.
1414 SECTION 2. Section 261.005, Family Code, is amended to read
1515 as follows:
1616 Sec. 261.005. REFERENCE TO EXECUTIVE COMMISSIONER OR
1717 COMMISSION. Except as provided for in Subchapter G, [I]in this
1818 chapter:
1919 (1) a reference to the executive commissioner or the
2020 executive commissioner of the Health and Human Services Commission
2121 means the commissioner of the department; and
2222 (2) a reference to the Health and Human Services
2323 Commission means the department.
2424 SECTION 3. Subchapter G, Chapter 261, Family Code, is
2525 enacted to read as follows:
2626 SUBCHAPTER G. TEXAS MEDICAL CHILD ABUSE RESOURCES AND EDUCATION
2727 SYSTEM (MEDCARES)
2828 Sec. 261.601. REFERENCE TO EXECUTIVE COMMISSIONER OR
2929 COMMISSION. In this Subchapter:
3030 (1) a reference to the executive commissioner means
3131 the executive commissioner of the Health and Human Services
3232 Commission; and
3333 (2) a reference to the commission means the Health and
3434 Human Services Commission.
3535 Sec. 261.602 TEXAS MEDICAL CHILD ABUSE RESOURCES AND
3636 EDUCATION SYSTEM GRANT PROGRAM. (a) The commission shall maintain
3737 the Texas Medical Child Abuse Resources and Education System
3838 (MEDCARES) grant program to award grants for the purpose of
3939 developing and supporting regional programs to improve the
4040 assessment, diagnosis, and treatment of child abuse and neglect as
4141 described by the report submitted to the 80th Legislature by the
4242 committee on pediatric centers of excellence relating to abuse and
4343 neglect in accordance with Section 266.0031, Family Code, as added
4444 by Chapter 1406 (S.B. 758), Acts of the 80th Legislature, Regular
4545 Session, 2007.
4646 (b) The commission may award grants to hospitals or academic
4747 health centers with expertise in pediatric health care and a
4848 demonstrated commitment to developing basic and advanced programs
4949 and centers of excellence for the assessment, diagnosis, and
5050 treatment of child abuse and neglect.
5151 (c) The department shall encourage collaboration among
5252 grant recipients in the development of program services and
5353 activities.
5454 Sec. 261.602. USE OF GRANT. A grant awarded under this
5555 subchapter may be used to support:
5656 (1) comprehensive medical evaluations, psychosocial
5757 assessments, treatment services, and written and photographic
5858 documentation of abuse;
5959 (2) education and training for health professionals,
6060 including physicians, medical students, resident physicians, child
6161 abuse fellows, and nurses, relating to the assessment, diagnosis,
6262 and treatment of child abuse and neglect;
6363 (3) education and training for community agencies
6464 involved with child abuse and neglect, law enforcement officials,
6565 child protective services staff, and children's advocacy centers
6666 involved with child abuse and neglect;
6767 (4) medical case reviews and consultations and
6868 testimony regarding those reviews and consultations;
6969 (5) research, data collection, and quality assurance
7070 activities, including the development of evidence-based guidelines
7171 and protocols for the prevention, evaluation, and treatment of
7272 child abuse and neglect;
7373 (6) the use of telemedicine and other means to extend
7474 services from regional programs into underserved areas; and
7575 (7) other necessary activities, services, supplies,
7676 facilities, and equipment as determined by the department.
7777 Sec. 261.603. GIFTS AND GRANTS. The commission may solicit
7878 and accept gifts, grants, and donations from any public or private
7979 source for the purposes of this subchapter.
8080 Sec. 261.604. REQUIRED REPORT. Not later than December 1 of
8181 each even-numbered year, the commission shall submit a report to
8282 the governor and the legislature regarding the grant activities of
8383 the program and grant recipients, including the results and
8484 outcomes of grants provided under this subchapter.
8585 Sec. 261.605. RULES. The executive commissioner may adopt
8686 rules as necessary to implement this subchapter.
8787 Sec. 261.606. APPROPRIATION REQUIRED. The commission is
8888 not required to award a grant under this subchapter unless the
8989 commission is specifically appropriated money for purposes of this
9090 subchapter.
9191 SECTION 4. The administration and oversight activities of
9292 the MEDCARES grant program is transferred from the Department of
9393 State Health Services to the Health and Human Services Commission
9494 as of the of the effective date of this Act.
9595 SECTION 5. This Act takes effect September 1, 2021.
