11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter F, Chapter 1001, Health and Safety |
---|
13 | 13 | | Code is hereby repealed. |
---|
14 | 14 | | SECTION 2. Section 261.005, Family Code, is amended to read |
---|
15 | 15 | | as follows: |
---|
16 | 16 | | Sec. 261.005. REFERENCE TO EXECUTIVE COMMISSIONER OR |
---|
17 | 17 | | COMMISSION. Except as provided for in Subchapter G, [I]in this |
---|
18 | 18 | | chapter: |
---|
19 | 19 | | (1) a reference to the executive commissioner or the |
---|
20 | 20 | | executive commissioner of the Health and Human Services Commission |

21 | 21 | | means the commissioner of the department; and |
---|
22 | 22 | | (2) a reference to the Health and Human Services |

23 | 23 | | Commission means the department. |
---|
24 | 24 | | SECTION 3. Subchapter G, Chapter 261, Family Code, is |
---|
25 | 25 | | enacted to read as follows: |

26 | 26 | | SUBCHAPTER G. TEXAS MEDICAL CHILD ABUSE RESOURCES AND EDUCATION |

27 | 27 | | SYSTEM (MEDCARES) |
---|
28 | 28 | | Sec. 261.601. REFERENCE TO EXECUTIVE COMMISSIONER OR |
---|
29 | 29 | | COMMISSION. In this Subchapter: |
---|
30 | 30 | | (1) a reference to the executive commissioner means |
---|
31 | 31 | | the executive commissioner of the Health and Human Services |
---|
32 | 32 | | Commission; and |
---|
33 | 33 | | (2) a reference to the commission means the Health and |
---|
34 | 34 | | Human Services Commission. |
---|
35 | 35 | | Sec. 261.602 TEXAS MEDICAL CHILD ABUSE RESOURCES AND |
---|
36 | 36 | | EDUCATION SYSTEM GRANT PROGRAM. (a) The commission shall maintain |
---|
37 | 37 | | the Texas Medical Child Abuse Resources and Education System |
---|
38 | 38 | | (MEDCARES) grant program to award grants for the purpose of |
---|
39 | 39 | | developing and supporting regional programs to improve the |
---|
40 | 40 | | assessment, diagnosis, and treatment of child abuse and neglect as |
---|
41 | 41 | | described by the report submitted to the 80th Legislature by the |
---|
42 | 42 | | committee on pediatric centers of excellence relating to abuse and |
---|
43 | 43 | | neglect in accordance with Section 266.0031, Family Code, as added |
---|
44 | 44 | | by Chapter 1406 (S.B. 758), Acts of the 80th Legislature, Regular |
---|
45 | 45 | | Session, 2007. |
---|
46 | 46 | | (b) The commission may award grants to hospitals or academic |
---|
47 | 47 | | health centers with expertise in pediatric health care and a |
---|
48 | 48 | | demonstrated commitment to developing basic and advanced programs |
---|
49 | 49 | | and centers of excellence for the assessment, diagnosis, and |
---|
50 | 50 | | treatment of child abuse and neglect. |
---|
51 | 51 | | (c) The department shall encourage collaboration among |
---|
52 | 52 | | grant recipients in the development of program services and |
---|
53 | 53 | | activities. |
---|
54 | 54 | | Sec. 261.602. USE OF GRANT. A grant awarded under this |
---|
55 | 55 | | subchapter may be used to support: |
---|
56 | 56 | | (1) comprehensive medical evaluations, psychosocial |
---|
57 | 57 | | assessments, treatment services, and written and photographic |
---|
58 | 58 | | documentation of abuse; |
---|
59 | 59 | | (2) education and training for health professionals, |
---|
60 | 60 | | including physicians, medical students, resident physicians, child |
---|
61 | 61 | | abuse fellows, and nurses, relating to the assessment, diagnosis, |
---|
62 | 62 | | and treatment of child abuse and neglect; |
---|
63 | 63 | | (3) education and training for community agencies |
---|
64 | 64 | | involved with child abuse and neglect, law enforcement officials, |
---|
65 | 65 | | child protective services staff, and children's advocacy centers |
---|
66 | 66 | | involved with child abuse and neglect; |
---|
67 | 67 | | (4) medical case reviews and consultations and |
---|
68 | 68 | | testimony regarding those reviews and consultations; |
---|
69 | 69 | | (5) research, data collection, and quality assurance |
---|
70 | 70 | | activities, including the development of evidence-based guidelines |
---|
71 | 71 | | and protocols for the prevention, evaluation, and treatment of |
---|
72 | 72 | | child abuse and neglect; |
---|
73 | 73 | | (6) the use of telemedicine and other means to extend |
---|
74 | 74 | | services from regional programs into underserved areas; and |
---|
75 | 75 | | (7) other necessary activities, services, supplies, |
---|
76 | 76 | | facilities, and equipment as determined by the department. |
---|
77 | 77 | | Sec. 261.603. GIFTS AND GRANTS. The commission may solicit |
---|
78 | 78 | | and accept gifts, grants, and donations from any public or private |
---|
79 | 79 | | source for the purposes of this subchapter. |
---|
80 | 80 | | Sec. 261.604. REQUIRED REPORT. Not later than December 1 of |
---|
81 | 81 | | each even-numbered year, the commission shall submit a report to |
---|
82 | 82 | | the governor and the legislature regarding the grant activities of |
---|
83 | 83 | | the program and grant recipients, including the results and |
---|
84 | 84 | | outcomes of grants provided under this subchapter. |
---|
85 | 85 | | Sec. 261.605. RULES. The executive commissioner may adopt |
---|
86 | 86 | | rules as necessary to implement this subchapter. |
---|
87 | 87 | | Sec. 261.606. APPROPRIATION REQUIRED. The commission is |
---|
88 | 88 | | not required to award a grant under this subchapter unless the |
---|
89 | 89 | | commission is specifically appropriated money for purposes of this |
---|
90 | 90 | | subchapter. |
---|
91 | 91 | | SECTION 4. The administration and oversight activities of |
---|
92 | 92 | | the MEDCARES grant program is transferred from the Department of |
---|
93 | 93 | | State Health Services to the Health and Human Services Commission |
---|
94 | 94 | | as of the of the effective date of this Act. |
---|
95 | 95 | | SECTION 5. This Act takes effect September 1, 2021. |
