66 AN ACT
77 relating to in-person visitation of religious counsel with
88 seriously ill or dying hospital patients and facility residents.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 241, Health and Safety
1111 Code, is amended by adding Section 241.012 to read as follows:
1212 Sec. 241.012. IN-PERSON VISITATION OF RELIGIOUS COUNSEL.
1313 (a) In this section, "religious counsel" means an individual
1414 acting substantially in a pastoral or religious capacity to counsel
1515 other individuals.
1616 (b) A hospital may not prohibit in-person visitation of
1717 religious counsel with a patient at the hospital who is seriously
1818 ill or dying.
1919 (c) Notwithstanding Subsection (b), a hospital may require
2020 religious counsel to:
2121 (1) submit to a health screening administered by the
2222 hospital; and
2323 (2) wear personal protective equipment at all times
2424 while visiting a patient at the hospital.
2525 (d) In the event of a conflict between this section and any
2626 other law, this section prevails.
2727 SECTION 2. Subchapter L, Chapter 242, Health and Safety
2828 Code, is amended by adding Section 242.506 to read as follows:
2929 Sec. 242.506. IN-PERSON VISITATION OF RELIGIOUS COUNSEL.
3030 (a) In this section, "religious counsel" means an individual
3131 acting substantially in a pastoral or religious capacity to counsel
3232 other individuals.
3333 (b) A facility may not prohibit in-person visitation of
3434 religious counsel with a resident of the facility who is seriously
3535 ill or dying.
3636 (c) Notwithstanding Subsection (b), a facility may require
3737 religious counsel to:
3838 (1) submit to a health screening administered by the
3939 facility; and
4040 (2) wear personal protective equipment at all times
4141 while visiting a resident at the facility.
4242 (d) In the event of a conflict between this section and any
4343 other law, this section prevails.
4444 SECTION 3. This Act takes effect immediately if it receives
4545 a vote of two-thirds of all the members elected to each house, as
4646 provided by Section 39, Article III, Texas Constitution. If this
4747 Act does not receive the vote necessary for immediate effect, this
4848 Act takes effect September 1, 2021.
