15 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

16 | 10 | | SECTION 1. Subchapter E, Chapter 67, Education Code, is |
---|
17 | 11 | | amended by adding Section 67.72 to read as follows: |
---|
18 | 12 | | Sec. 67.72. TEXNET TECHNICAL ADVISORY COMMITTEE. (a) In |
---|
19 | 13 | | this section, "program" means the TexNet seismic monitoring program |
---|
20 | 14 | | administered by the bureau. |
---|
21 | 15 | | (b) The TexNet Technical Advisory Committee is established |
---|
22 | 16 | | as an advisory committee within the bureau. |
---|
23 | 17 | | (c) The advisory committee consists of nine members |
---|
26 | 19 | | (1) one representative of the Railroad Commission of |
---|
27 | 20 | | Texas who specializes in seismology, geomechanical engineering, |
---|
28 | 21 | | reservoir engineering, or another related field recommended to the |
---|
29 | 22 | | governor by the executive director of the Railroad Commission of |
---|
30 | 23 | | Texas; and |
---|
31 | 24 | | (2) at least three representatives from the oil and |
---|
32 | 25 | | gas industry, not to include the representative appointed under |
---|
33 | 26 | | Subdivision (1). |
---|
34 | 27 | | (d) The governor shall designate a member of the advisory |
---|
35 | 28 | | committee as the chair of the advisory committee to serve in that |
---|
36 | 29 | | capacity at the pleasure of the governor. |
---|
37 | 30 | | (e) A person affiliated with the bureau or under contract |
---|
38 | 31 | | for services with the bureau may not serve as a voting member of the |
---|
39 | 32 | | advisory committee. |
---|
40 | 33 | | (f) The director of the bureau shall serve, ex officio, as a |
---|
41 | 34 | | nonvoting member of the advisory committee. |
---|
42 | 35 | | (g) The advisory committee shall: |
---|
43 | 36 | | (1) in coordination with the bureau, develop |
---|
44 | 37 | | recommendations for a program of work to assist the program and any |
---|
45 | 38 | | research efforts affiliated with the program in accomplishing the |
---|
46 | 39 | | goals of the program, including recommendations regarding: |
---|
47 | 40 | | (A) the acquisition and deployment of equipment; |
---|
48 | 41 | | (B) contracting with vendors; |
---|
49 | 42 | | (C) determining the scope of research programs |
---|
50 | 43 | | associated with the program; and |
---|
51 | 44 | | (D) determining the scope of any use of funds |
---|
52 | 45 | | appropriated by the legislature for the program or associated |
---|
53 | 46 | | research; |
---|
54 | 47 | | (2) review and approve or reject expenditures made in |
---|
55 | 48 | | connection with the program; |
---|
56 | 49 | | (3) prepare and approve an annual budget for the use of |
---|
57 | 50 | | any funds appropriated for the program by the legislature; |
---|
58 | 51 | | (4) provide oversight and input on the acquisition, |
---|
59 | 52 | | deployment, and operation of new and existing program equipment; |
---|
60 | 53 | | (5) ensure that there is a monthly transmission of the |
---|
61 | 54 | | data collected by seismic equipment operated under the program to |
---|
62 | 55 | | the Incorporated Research Institutions for Seismology database; |
---|
63 | 56 | | and |
---|
64 | | - | (6) meet with the bureau quarterly to discuss the |
---|
65 | | - | progress of the program, expenditures made in connection with the |
---|
66 | | - | program, and any other information related to the program that the |
---|
67 | | - | advisory committee finds necessary. |
---|
68 | | - | (h) Not later than December 31 of each even-numbered year, |
---|
69 | | - | the advisory committee and the bureau jointly shall prepare and |
---|
70 | | - | submit to the governor, the lieutenant governor, and the speaker of |
---|
71 | | - | the house of representatives a report that includes: |
---|

---|
74 | 67 | | (2) a complete listing and accounting of all research |
---|
75 | 68 | | funded through the program, including: |
---|
76 | 69 | | (A) a list of contractors employed under the |
---|
77 | 70 | | program; |
---|
78 | 71 | | (B) an itemized budget for each program element; |
---|
79 | 72 | | and |
---|
80 | 73 | | (C) a list of the geographic coverage of the |
---|
81 | 74 | | program; and |
---|
82 | 75 | | (3) recommendations related to the ongoing operations |
---|
83 | 76 | | and requirements of the program. |
---|
84 | 77 | | SECTION 2. This Act takes effect September 1, 2021. |
