115 A BILL TO BE ENTITLED
126 AN ACT
137 relating to the establishment of an advisory committee for the
148 TexNet seismic monitoring program.
159 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1610 SECTION 1. Subchapter E, Chapter 67, Education Code, is
1711 amended by adding Section 67.72 to read as follows:
1812 Sec. 67.72. TEXNET TECHNICAL ADVISORY COMMITTEE. (a) In
1913 this section, "program" means the TexNet seismic monitoring program
2014 administered by the bureau.
2115 (b) The TexNet Technical Advisory Committee is established
2216 as an advisory committee within the bureau.
2317 (c) The advisory committee consists of nine members
24- appointed by the governor who work or reside in this state,
25- including:
18+ appointed by the governor, including:
2619 (1) one representative of the Railroad Commission of
2720 Texas who specializes in seismology, geomechanical engineering,
2821 reservoir engineering, or another related field recommended to the
2922 governor by the executive director of the Railroad Commission of
3023 Texas; and
3124 (2) at least three representatives from the oil and
3225 gas industry, not to include the representative appointed under
3326 Subdivision (1).
3427 (d) The governor shall designate a member of the advisory
3528 committee as the chair of the advisory committee to serve in that
3629 capacity at the pleasure of the governor.
3730 (e) A person affiliated with the bureau or under contract
3831 for services with the bureau may not serve as a voting member of the
3932 advisory committee.
4033 (f) The director of the bureau shall serve, ex officio, as a
4134 nonvoting member of the advisory committee.
4235 (g) The advisory committee shall:
4336 (1) in coordination with the bureau, develop
4437 recommendations for a program of work to assist the program and any
4538 research efforts affiliated with the program in accomplishing the
4639 goals of the program, including recommendations regarding:
4740 (A) the acquisition and deployment of equipment;
4841 (B) contracting with vendors;
4942 (C) determining the scope of research programs
5043 associated with the program; and
5144 (D) determining the scope of any use of funds
5245 appropriated by the legislature for the program or associated
5346 research;
5447 (2) review and approve or reject expenditures made in
5548 connection with the program;
5649 (3) prepare and approve an annual budget for the use of
5750 any funds appropriated for the program by the legislature;
5851 (4) provide oversight and input on the acquisition,
5952 deployment, and operation of new and existing program equipment;
6053 (5) ensure that there is a monthly transmission of the
6154 data collected by seismic equipment operated under the program to
6255 the Incorporated Research Institutions for Seismology database;
6356 and
64- (6) meet with the bureau quarterly to discuss the
65- progress of the program, expenditures made in connection with the
66- program, and any other information related to the program that the
67- advisory committee finds necessary.
68- (h) Not later than December 31 of each even-numbered year,
69- the advisory committee and the bureau jointly shall prepare and
70- submit to the governor, the lieutenant governor, and the speaker of
71- the house of representatives a report that includes:
57+ (6) solicit from the bureau quarterly updates
58+ regarding the progress of the program, expenditures made in
59+ connection with the program, and any other information related to
60+ the program that the advisory committee finds necessary.
61+ (h) Not later than December 1 of each even-numbered year,
62+ the advisory committee shall prepare and submit to the governor,
63+ the lieutenant governor, and the speaker of the house of
64+ representatives a report that includes:
7265 (1) a review of the use of any funds appropriated for
7366 the program by the legislature;
7467 (2) a complete listing and accounting of all research
7568 funded through the program, including:
7669 (A) a list of contractors employed under the
7770 program;
7871 (B) an itemized budget for each program element;
7972 and
8073 (C) a list of the geographic coverage of the
8174 program; and
8275 (3) recommendations related to the ongoing operations
8376 and requirements of the program.
8477 SECTION 2. This Act takes effect September 1, 2021.
