46 AN ACT
57 relating to the authorized activities of a holder of a brewpub
68 license.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 74.01, Alcoholic Beverage Code, as
911 effective September 1, 2021, is amended by amending Subsection (a)
1012 and adding Subsection (a-1) to read as follows:
1113 (a) A holder of a brewpub license for a brewpub located in a
1214 wet area, as that term is described by Section 251.71, may:
1315 (1) brew, bottle, can, package, and label malt
1416 beverages;
1517 (2) sell or offer without charge, on the premises of
1618 the brewpub, to ultimate consumers for consumption on or off those
1719 premises, malt beverages produced by the holder, in or from a lawful
1820 container, to the extent the sales or offers are allowed under the
1921 holder's other permits or licenses; [and]
2022 (3) sell food on the premises of the holder's
2123 breweries; and
2224 (4) conduct samplings of malt beverages, including
2325 tastings, at a retailer's premises.
2426 (a-1) An agent or employee of the holder of a brewpub
2527 license may open, touch, or pour malt beverages, make a
2628 presentation, or answer questions at a sampling event.
2729 SECTION 2. This Act takes effect September 1, 2021.
