10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 37.056, Utilities Code, is amended by | |
12 | 12 | adding Subsection (g-1) to read as follows: | |
13 | 13 | (g-1) In an application proceeding for a municipally owned | |
14 | 14 | utility seeking a certificate for a new transmission line or | |
15 | 15 | facility in the extraterritorial jurisdiction of the municipality, | |
16 | 16 | an electric utility may file a motion requesting that the | |
17 | 17 | commission consider granting the certificate to the electric | |
18 | 18 | utility. Subsections (e) and (f) do not apply to the new | |
19 | 19 | transmission facility or line if a motion is filed under this | |
20 | 20 | subsection. | |
21 | 21 | SECTION 2. This Act takes effect September 1, 2021. |
