55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to prohibiting certain limitations on the operation of
88 certain alcoholic beverage businesses during a declared state of
99 disaster.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 418.012, Government Code, is amended to
1212 read as follows:
1313 Sec. 418.012. EXECUTIVE ORDERS. (a) Under this chapter,
1414 the governor may issue executive orders, proclamations, and
1515 regulations and amend or rescind them. Executive orders,
1616 proclamations, and regulations have the force and effect of law.
1717 (b) An executive order, proclamation, or regulation issued
1818 by the governor under this chapter that restricts the operation of
1919 or the hours of operation for a business that sells alcoholic
2020 beverages may not include:
2121 (1) a business that holds a permit or license:
2222 (A) issued by the Texas Alcoholic Beverage
2323 Commission;
2424 (B) for a business in the manufacturing tier of
2525 the alcoholic beverage industry; and
2626 (C) that authorizes the business to sell
2727 alcoholic beverages for on-premises consumption; or
2828 (2) a business that holds a brewpub license under
2929 Chapter 74, Alcoholic Beverage Code.
3030 SECTION 2. Section 418.012, Government Code, as amended by
3131 this Act, applies only to a declaration of a state of disaster
3232 issued or renewed on or after the effective date of this Act. A
3333 declaration issued before the effective date of this Act is
3434 governed by the law in effect immediately before the effective date
3535 of this Act, and that law is continued in effect for that purpose.
3636 SECTION 3. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2021.
