| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Section 442.014, Government Code, is amended to |
|---|
| 9 | 11 | | read as follows: |
|---|
| 10 | 12 | | Sec. 442.014. MAIN STREET PROGRAM. (a) The commission |
|---|
| 11 | 13 | | shall administer a main street program to assist communities |
|---|
| 12 | 14 | | [municipalities] with the development, restoration, and |
|---|
| 13 | 15 | | preservation of their historic neighborhood commercial districts |
|---|
| 14 | 16 | | and central business districts. |
|---|
| 15 | 17 | | (b) The [Each year the] commission shall designate certain |
|---|
| 16 | 18 | | communities [municipalities] to participate in the program as |
|---|
| 17 | 19 | | official main street cities. |
|---|
| 18 | 20 | | (c) The commission by rule shall prescribe the frequency of |
|---|
| 19 | 21 | | community designations and qualification standards for |
|---|
| 20 | 22 | | participation in the program [as a main street city or as an urban |
|---|
| 21 | 23 | | main street city. Any municipality not designated under Subsection |
|---|
| 22 | 24 | | (b) may apply with the commission to participate in the program |
|---|
| 23 | 25 | | under this subsection]. |
|---|
| 24 | 26 | | (d) The commission by rule shall prescribe a fee schedule |
|---|
| 25 | 27 | | for participation in the program under Subsection (c). The |
|---|
| 26 | 28 | | commission shall collect fees from the participating communities |
|---|
| 27 | 29 | | [municipalities] to offset [recover the] costs of participation in |
|---|
| 28 | 30 | | the program. |
|---|
| 29 | 31 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 30 | 32 | | of this Act, the Texas Historical Commission shall adopt the rules |
|---|
| 31 | 33 | | necessary to administer Section 442.014, Government Code, as |
|---|
| 32 | 34 | | amended by this Act. |
|---|
| 33 | 35 | | SECTION 3. This Act takes effect September 1, 2021. |
