8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 12.005, Utilities Code, is amended to |
---|
10 | 10 | | read as follows: |
---|
11 | 11 | | Sec. 12.005. APPLICATION OF SUNSET ACT. The Public Utility |
---|
12 | 12 | | Commission of Texas is subject to Chapter 325, Government Code |
---|
13 | 13 | | (Texas Sunset Act). Unless continued in existence as provided by |
---|
14 | 14 | | that chapter or by Chapter 39, the commission is abolished and this |
---|
15 | 15 | | title expires September 1, 2023 [2025]. The Sunset Advisory |
---|
16 | 16 | | Commission may recommend that the Public Utility Commission of |
---|
17 | 17 | | Texas decertify an independent organization certified under |
---|
18 | 18 | | Section 39.151 for the ERCOT power region. |

19 | 19 | | SECTION 2. Section 13.002, Utilities Code, is amended to |
---|
20 | 20 | | read as follows: |

21 | 21 | | Sec. 13.002. APPLICATION OF SUNSET ACT. The Office of |
---|
22 | 22 | | Public Utility Counsel is subject to Chapter 325, Government Code |
---|
23 | 23 | | (Texas Sunset Act). Unless continued in existence as provided by |
---|
24 | 24 | | that chapter, the office is abolished and this chapter expires |
---|
25 | 25 | | September 1, 2023 [2025]. |

26 | 26 | | SECTION 3. This Act takes effect immediately if it receives |
---|
27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
---|
28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
---|
30 | 30 | | Act takes effect September 1, 2021. |
