5	10		AN ACT
6	11		relating to consumption of alcoholic beverages in public
7	12		entertainment facilities and zones.
8	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	14		SECTION 1. Section 108.73, Alcoholic Beverage Code, is
10	15		amended by adding Subdivision (3-a) to read as follows:
11	16		(3-a) "Public entertainment zone" means an area of
12	17		land that:
13	18		(A) is owned by a municipality with a population
14	19		of 175,000 or more;
15	20		(B) is designated as a public entertainment zone
16	21		by the governing body of a municipality in a formal meeting; and
17	22		(C) contains a public safety facility.
18	23		SECTION 2. The heading to Section 108.82, Alcoholic
19	24		Beverage Code, is amended to read as follows:
20	25		Sec. 108.82. ALCOHOLIC BEVERAGE CONSUMPTION IN PUBLIC
21	26		ENTERTAINMENT FACILITIES AND ZONES.
22	27		SECTION 3. Sections 108.82(a) and (b), Alcoholic Beverage
23	28		Code, are amended to read as follows:
24	29		(a) This section applies only to [a public entertainment
25	30		facility]:
26	31		(1) a public entertainment facility that is owned or
27	32		leased by the Texas State Railroad Authority and used as a station
28	33		for passenger rail services; [or]
29	34		(2) a public entertainment facility that is a stadium,
30	35		arena, or other permanent structure that is used for sporting
31	36		events and:
32	37		(A) relating to which an agreement approved by
33	38		the administrator under Section 108.79 is in force; and
34	39		(B) for which all alcoholic beverage permits and
35	40		licenses are held by a single holder; or
36	41		(3) a public entertainment zone.
37	42		(b) Notwithstanding Section 28.10, the concessionaire for a
38	43		public entertainment facility or a public entertainment zone
39	44		described by Subsection (a) may allow a patron who possesses an
40	45		alcoholic beverage to enter or leave a licensed or permitted
41	46		premises within the facility or zone if the alcoholic beverage:
42	47		(1) is in an open container, as defined by Section
43	48		49.031, Penal Code;
44	49		(2) appears to be possessed for present consumption;
45	50		(3) except as provided by Section 48.01(b), remains
46	51		within the confines of the facility or zone, excluding a parking
47	52		lot; and
48	53		(4) was purchased legally at a licensed or permitted
49	54		premises within the facility or zone.
50	55		SECTION 4. This Act takes effect September 1, 2021.
