| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 545.058(c), Transportation Code, is | |
| 11 | 11 | amended to read as follows: | |
| 12 | 12 | (c) A limitation in this section on driving on an improved | |
| 13 | 13 | shoulder does not apply to: | |
| 14 | 14 | (1) an authorized emergency vehicle responding to a | |
| 15 | 15 | call; | |
| 16 | 16 | (2) a police patrol; | |
| 17 | 17 | (3) a bicycle; [or] | |
| 18 | 18 | (4) a slow-moving vehicle, as defined by Section | |
| 19 | 19 | 547.001; or | |
| 20 | 20 | (5) a public transit motor bus of a mass transit entity | |
| 21 | 21 | operating under Subtitle K, Title 6, if the motor bus is: | |
| 22 | 22 | (A) operating within the boundaries of a | |
| 23 | 23 | metropolitan planning organization in which: | |
| 24 | 24 | (i) at least five counties are located; and | |
| 25 | 25 | (ii) the two counties with the largest | |
| 26 | 26 | populations are part of a regional mobility authority governed by | |
| 27 | 27 | Chapter 370; and | |
| 28 | 28 | (B) bypassing traffic on a highway that is under | |
| 29 | 29 | construction by operating on a shoulder designated by the Texas | |
| 30 | 30 | Department of Transportation. | |
| 31 | 31 | SECTION 2. This Act takes effect September 1, 2021. |
