| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 142.009, Election Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | Sec. 142.009. PETITION TO BE CIRCULATED AFTER PRIMARY. A |
|---|
| 14 | 14 | | signature on a candidate's petition is invalid if the signer[: |
|---|
| 15 | 15 | | [(1)] signed the petition on or before general primary |
|---|
| 16 | 16 | | election day or, if a runoff primary is held for the office sought |
|---|
| 17 | 17 | | by the candidate, on or before runoff primary election day[; or |
|---|
| 18 | 18 | | [(2) voted in the general or runoff primary election |
|---|
| 19 | 19 | | of a political party that made a nomination, at either primary, for |
|---|
| 20 | 20 | | the office sought by the candidate]. |
|---|
| 21 | 21 | | SECTION 2. Section 181.006(f), Election Code, is amended to |
|---|
| 22 | 22 | | read as follows: |
|---|
| 23 | 23 | | (f) The following statement must appear at the top of each |
|---|
| 24 | 24 | | page of the petition: "I know that the purpose of this petition is |
|---|
| 25 | 25 | | to entitle the _______ Party to have its nominees placed on the |
|---|
| 26 | 26 | | ballot in the general election for state and county officers. [I |
|---|
| 27 | 27 | | have not voted in a primary election or participated in a convention |
|---|
| 28 | 28 | | of another party during this voting year, and I understand that I |
|---|
| 29 | 29 | | become ineligible to do so by signing this petition. I understand |
|---|
| 30 | 30 | | that signing more than one petition to entitle a party to have its |
|---|
| 31 | 31 | | nominees placed on the general election ballot in the same election |
|---|
| 32 | 32 | | is prohibited.]" |
|---|
| 33 | 33 | | SECTION 3. Section 182.004(f), Election Code, is amended to |
|---|
| 34 | 34 | | read as follows: |
|---|
| 35 | 35 | | (f) Sections 181.006(f) and (j) [181.006(f)-(j)] apply to a |
|---|
| 36 | 36 | | petition circulated under this section. |
|---|
| 37 | 37 | | SECTION 4. The following provisions of the Election Code |
|---|
| 38 | 38 | | are repealed: |
|---|
| 39 | 39 | | (1) Section 142.008; and |
|---|
| 40 | 40 | | (2) Sections 181.006(g), (h), and (i). |
|---|
| 41 | 41 | | SECTION 5. This Act takes effect September 1, 2021. |
