55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the eligibility to sign certain petitions in connection
88 with certain applications for placement on a general election
99 ballot.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 142.009, Election Code, is amended to
1212 read as follows:
1313 Sec. 142.009. PETITION TO BE CIRCULATED AFTER PRIMARY. A
1414 signature on a candidate's petition is invalid if the signer[:
1515 [(1)] signed the petition on or before general primary
1616 election day or, if a runoff primary is held for the office sought
1717 by the candidate, on or before runoff primary election day[; or
1818 [(2) voted in the general or runoff primary election
1919 of a political party that made a nomination, at either primary, for
2020 the office sought by the candidate].
2121 SECTION 2. Section 181.006(f), Election Code, is amended to
2222 read as follows:
2323 (f) The following statement must appear at the top of each
2424 page of the petition: "I know that the purpose of this petition is
2525 to entitle the _______ Party to have its nominees placed on the
2626 ballot in the general election for state and county officers. [I
2727 have not voted in a primary election or participated in a convention
2828 of another party during this voting year, and I understand that I
2929 become ineligible to do so by signing this petition. I understand
3030 that signing more than one petition to entitle a party to have its
3131 nominees placed on the general election ballot in the same election
3232 is prohibited.]"
3333 SECTION 3. Section 182.004(f), Election Code, is amended to
3434 read as follows:
3535 (f) Sections 181.006(f) and (j) [181.006(f)-(j)] apply to a
3636 petition circulated under this section.
3737 SECTION 4. The following provisions of the Election Code
3838 are repealed:
3939 (1) Section 142.008; and
4040 (2) Sections 181.006(g), (h), and (i).
4141 SECTION 5. This Act takes effect September 1, 2021.
