55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to provider discrimination against a Medicaid recipient or
88 child health plan program enrollee based on immunization status.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1111 amended by adding Section 531.02119 to read as follows:
1212 Sec. 531.02119. DISCRIMINATION BASED ON IMMUNIZATION
1313 STATUS PROHIBITED. (a) A provider who participates in Medicaid or
1414 the child health plan program, including a provider participating
1515 in the provider network of a managed care organization that
1616 contracts with the commission to provide services under Medicaid or
1717 the child health plan program, may not refuse to provide health care
1818 services to a Medicaid recipient or child health plan program
1919 enrollee based on the recipient's or enrollee's refusal or failure
2020 to obtain a vaccine or immunization for a particular infectious or
2121 communicable disease.
2222 (b) The commission may not provide reimbursement and shall
2323 disenroll from participation as a provider under Medicaid or the
2424 child health plan program a provider who violates this section.
2525 (c) The executive commissioner may adopt rules as necessary
2626 to implement this section.
2727 SECTION 2. If before implementing any provision of this Act
2828 a state agency determines that a waiver or authorization from a
2929 federal agency is necessary for implementation of that provision,
3030 the agency affected by the provision shall request the waiver or
3131 authorization and may delay implementing that provision until the
3232 waiver or authorization is granted.
3333 SECTION 3. This Act takes effect September 1, 2021.
