| 7 | 7 | | relating to provider discrimination against a Medicaid recipient or |

| 8 | 8 | | child health plan program enrollee based on immunization status. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 531, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 531.02119 to read as follows: |
|---|
| 12 | 12 | | Sec. 531.02119. DISCRIMINATION BASED ON IMMUNIZATION |
|---|
| 13 | 13 | | STATUS PROHIBITED. (a) A provider who participates in Medicaid or |
|---|
| 14 | 14 | | the child health plan program, including a provider participating |
|---|
| 15 | 15 | | in the provider network of a managed care organization that |
|---|
| 16 | 16 | | contracts with the commission to provide services under Medicaid or |
|---|
| 17 | 17 | | the child health plan program, may not refuse to provide health care |
|---|
| 18 | 18 | | services to a Medicaid recipient or child health plan program |
|---|
| 19 | 19 | | enrollee based on the recipient's or enrollee's refusal or failure |
|---|
| 20 | 20 | | to obtain a vaccine or immunization for a particular infectious or |
|---|
| 21 | 21 | | communicable disease. |
|---|
| 22 | 22 | | (b) The commission may not provide reimbursement and shall |
|---|
| 23 | 23 | | disenroll from participation as a provider under Medicaid or the |
|---|
| 24 | 24 | | child health plan program a provider who violates this section. |
|---|
| 25 | 25 | | (c) The executive commissioner may adopt rules as necessary |
|---|
| 26 | 26 | | to implement this section. |
|---|
| 27 | 27 | | SECTION 2. If before implementing any provision of this Act |
|---|
| 28 | 28 | | a state agency determines that a waiver or authorization from a |
|---|
| 29 | 29 | | federal agency is necessary for implementation of that provision, |
|---|
| 30 | 30 | | the agency affected by the provision shall request the waiver or |
|---|
| 31 | 31 | | authorization and may delay implementing that provision until the |
|---|
| 32 | 32 | | waiver or authorization is granted. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect September 1, 2021. |
