5	5	A BILL TO BE ENTITLED
6	6	AN ACT
7	7	relating to the authority of the commissioner of education to
8	8	conduct special accreditation investigations.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 39.057(a), Education Code, is amended to
11	11	read as follows:
12	12	(a) The commissioner may authorize special accreditation
13	13	investigations to be conducted:
14	14	(1) when excessive numbers of absences of students
15	15	eligible to be tested on state assessment instruments are
16	16	determined;
17	17	(2) when excessive numbers of allowable exemptions
18	18	from the required state assessment instruments are determined;
19	19	(3) in response to complaints submitted to the agency
20	20	with respect to alleged violations of civil rights or other
21	21	requirements imposed on the state by federal law or court order;
22	22	(4) in response to established compliance reviews of
23	23	the district's financial accounting practices and state and federal
24	24	program requirements;
25	25	(5) when extraordinary numbers of student placements
26	26	in disciplinary alternative education programs, other than
27	27	placements under Sections 37.006 and 37.007, are determined;
28	28	(6) in response to an allegation involving a conflict
29	29	between members of the board of trustees or between the board and
30	30	the district administration if it appears that the conflict
31	31	involves a violation of a role or duty of the board members or the
32	32	administration clearly defined by this code;
33	33	(7) when excessive numbers of students in special
34	34	education programs under Subchapter A, Chapter 29, are assessed
35	35	through assessment instruments developed or adopted under Section
36	36	39.023(b);
37	37	(8) in response to an allegation regarding or an
38	38	analysis using a statistical method result indicating a possible
39	39	violation of an assessment instrument security procedure
40	40	established under Section 39.0301, including for the purpose of
41	41	investigating or auditing a school district under that section;
42	42	(9) when a significant pattern of decreased academic
43	43	performance has developed as a result of the promotion in the
44	44	preceding two school years of students who did not perform
45	45	satisfactorily as determined by the commissioner under Section
46	46	39.0241(a) on assessment instruments administered under Section
47	47	39.023(a), (c), or (l);
48	48	(10) when excessive numbers of students eligible to
49	49	enroll fail to complete an Algebra II course or any other advanced
50	50	course as determined by the commissioner;
51	51	(11) when resource allocation practices as evaluated
52	52	under Section 39.0821 indicate a potential for significant
53	53	improvement in resource allocation;
54	54	(12) when a disproportionate number of students of a
55	55	particular demographic group is graduating with a particular
56	56	endorsement under Section 28.025(c-1);
57	57	(13) when an excessive number of students is
58	58	graduating with a particular endorsement under Section
59	59	28.025(c-1);
60	60	(14) in response to a complaint submitted to the
61	61	agency with respect to alleged inaccurate data that is reported
62	62	through the Public Education Information Management System (PEIMS)
63	63	or through other reports required by state or federal law or rule or
64	64	court order and that is used by the agency to make a determination
65	65	relating to public school accountability, including accreditation,
66	66	under this chapter;
67	67	(15) when a school district for any reason fails to
68	68	produce, at the request of the agency, evidence or an investigation
69	69	report relating to an educator who is under investigation by the
70	70	State Board for Educator Certification; [or]
71	71	(16) when an excessive number of students is
72	72	transferring out of a school district or between campuses within a
73	73	school district:
74	74	(A) after completing the second grade and before
75	75	entering the third grade; or
76	76	(B) during the 60 days before the date of the
77	77	administration of an assessment instrument under Section 39.023; or
78	78	(17) as the commissioner otherwise determines
79	79	necessary.
80	80	SECTION 2. This Act takes effect immediately if it receives
81	81	a vote of two-thirds of all the members elected to each house, as
82	82	provided by Section 39, Article III, Texas Constitution. If this
83	83	Act does not receive the vote necessary for immediate effect, this
84	84	Act takes effect September 1, 2021.
