77 relating to the investigation of municipal fire fighters.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 614, Government Code, is
1010 amended by adding Section 614.024 to read as follows:
1111 Sec. 614.024. INVESTIGATION OF MUNICIPAL FIRE FIGHTERS
1212 REQUIRED. (a) In this section:
1313 (1) "Fire fighter" means a paid employee of a
1414 municipal fire department.
1515 (2) "Investigation" means an administrative
1616 investigation conducted by a municipality of alleged misconduct by
1717 a fire fighter that could result in punitive action against the fire
1818 fighter.
1919 (3) "Punitive action" means a disciplinary
2020 suspension, indefinite suspension, demotion in rank, reprimand, or
2121 any combination of those actions.
2222 (b) Notwithstanding Section 614.021(b), this section
2323 applies to a fire fighter employed by a municipality regardless of
2424 whether the municipality is covered by a meet and confer or
2525 collective bargaining agreement under Chapter 143 or 174, Local
2626 Government Code.
2727 (c) In addition to the requirements of Section 614.023, a
2828 municipality may not take punitive action against a fire fighter
2929 unless an investigation has been conducted in accordance with
3030 Section 143.123 or 143.312, Local Government Code, or other
3131 applicable law.
3232 (d) A municipality to which Section 143.123 or 143.312,
3333 Local Government Code, or another substantially similar
3434 investigation requirement does not apply shall adopt and comply
3535 with procedures substantially identical to those required by
3636 Section 143.312, Local Government Code.
3737 SECTION 2. Section 614.023(a), Government Code, is amended
3838 to read as follows:
3939 (a) A copy of a signed complaint against a law enforcement
4040 officer of this state or a fire fighter, detention officer, county
4141 jailer, or peace officer appointed or employed by a political
4242 subdivision of this state shall be given to the officer or employee:
4343 (1) within a reasonable time after the complaint is
4444 filed; or
4545 (2) for a municipal fire fighter, in accordance with
4646 procedures adopted under Section 614.024(d).
4747 SECTION 3. Section 614.024, Government Code, as added by
4848 this Act, applies only to an investigation, as that term is defined
4949 by that section, initiated by a municipality on or after the
5050 effective date of this Act.
5151 SECTION 4. This Act takes effect September 1, 2021.
