| 7 | 7 | | relating to the investigation of municipal fire fighters. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter B, Chapter 614, Government Code, is |
|---|
| 10 | 10 | | amended by adding Section 614.024 to read as follows: |
|---|
| 11 | 11 | | Sec. 614.024. INVESTIGATION OF MUNICIPAL FIRE FIGHTERS |
|---|
| 12 | 12 | | REQUIRED. (a) In this section: |
|---|
| 13 | 13 | | (1) "Fire fighter" means a paid employee of a |
|---|
| 14 | 14 | | municipal fire department. |
|---|
| 15 | 15 | | (2) "Investigation" means an administrative |
|---|
| 16 | 16 | | investigation conducted by a municipality of alleged misconduct by |
|---|
| 17 | 17 | | a fire fighter that could result in punitive action against the fire |
|---|
| 18 | 18 | | fighter. |
|---|
| 19 | 19 | | (3) "Punitive action" means a disciplinary |
|---|
| 20 | 20 | | suspension, indefinite suspension, demotion in rank, reprimand, or |
|---|
| 21 | 21 | | any combination of those actions. |
|---|
| 22 | 22 | | (b) Notwithstanding Section 614.021(b), this section |
|---|
| 23 | 23 | | applies to a fire fighter employed by a municipality regardless of |
|---|
| 24 | 24 | | whether the municipality is covered by a meet and confer or |
|---|
| 25 | 25 | | collective bargaining agreement under Chapter 143 or 174, Local |
|---|
| 26 | 26 | | Government Code. |
|---|
| 27 | 27 | | (c) In addition to the requirements of Section 614.023, a |
|---|
| 28 | 28 | | municipality may not take punitive action against a fire fighter |
|---|
| 29 | 29 | | unless an investigation has been conducted in accordance with |
|---|
| 30 | 30 | | Section 143.123 or 143.312, Local Government Code, or other |
|---|
| 31 | 31 | | applicable law. |
|---|
| 32 | 32 | | (d) A municipality to which Section 143.123 or 143.312, |
|---|
| 33 | 33 | | Local Government Code, or another substantially similar |
|---|
| 34 | 34 | | investigation requirement does not apply shall adopt and comply |
|---|
| 35 | 35 | | with procedures substantially identical to those required by |
|---|
| 36 | 36 | | Section 143.312, Local Government Code. |
|---|
| 37 | 37 | | SECTION 2. Section 614.023(a), Government Code, is amended |
|---|
| 38 | 38 | | to read as follows: |
|---|
| 39 | 39 | | (a) A copy of a signed complaint against a law enforcement |
|---|
| 40 | 40 | | officer of this state or a fire fighter, detention officer, county |
|---|
| 41 | 41 | | jailer, or peace officer appointed or employed by a political |
|---|
| 42 | 42 | | subdivision of this state shall be given to the officer or employee: |
|---|
| 43 | 43 | | (1) within a reasonable time after the complaint is |
|---|
| 44 | 44 | | filed; or |
|---|
| 45 | 45 | | (2) for a municipal fire fighter, in accordance with |
|---|
| 46 | 46 | | procedures adopted under Section 614.024(d). |
|---|
| 47 | 47 | | SECTION 3. Section 614.024, Government Code, as added by |
|---|
| 48 | 48 | | this Act, applies only to an investigation, as that term is defined |
|---|
| 49 | 49 | | by that section, initiated by a municipality on or after the |
|---|
| 50 | 50 | | effective date of this Act. |
|---|
| 51 | 51 | | SECTION 4. This Act takes effect September 1, 2021. |
