| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. In order to carry out district purposes, the | |
| 11 | 11 | Hidalgo County Drainage District Number 1 may remove real or | |
| 12 | 12 | personal property placed on land owned by the district or land | |
| 13 | 13 | subject to an easement held by the district, regardless of when the | |
| 14 | 14 | real or personal property was put in place and without the consent | |
| 15 | 15 | of the owner of the property. The district must send notice by | |
| 16 | 16 | certified mail to the owner of property on which the district | |
| 17 | 17 | intends to act under this section. Not earlier than the 30th day | |
| 18 | 18 | after the date the notice is sent, the district must send a second | |
| 19 | 19 | notice by certified mail. The district may use existing civil | |
| 20 | 20 | lawsuit processes against the owner of the property to recover the | |
| 21 | 21 | cost of removing the property not earlier than the 30th day after | |
| 22 | 22 | the date the second notice was received. | |
| 23 | 23 | SECTION 2. This Act takes effect September 1, 2021. |
