77 relating to the regulation of the recycling of oil and gas waste.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 122.004, Natural Resources Code, is
1010 amended to read as follows:
1111 Sec. 122.004. COMMISSION RULES FOR TREATMENT AND BENEFICIAL
1212 USE. (a) The commission shall adopt rules to govern the treatment
1313 and beneficial use of oil and gas waste.
1414 (b) Except as provided by Subsection (c), rules adopted
1515 under this section must not differ in treatment of commercial and
1616 noncommercial recycling of fluid oil and gas waste.
1717 (c) Rules adopted under this section must establish:
1818 (1) minimum siting standards for commercial fluid
1919 recycling pits;
2020 (2) uniform technical, construction, and sampling
2121 standards consistent with noncommercial recycling standards for
2222 fluid oil and gas waste;
2323 (3) minimum and maximum bonding and financial security
2424 amounts for commercial fluid recyclers; and
2525 (4) standards for sampling and analysis of fluid oil
2626 and gas waste.
2727 (d) The commission shall approve or deny an application for
2828 a permit issued under rules adopted under this section not later
2929 than the 90th day after the date the complete application was
3030 received by the commission. If the commission does not approve or
3131 deny the application before that date, the permit application is
3232 considered approved and the applicant may operate under the terms
3333 specified in the application for a period of one year.
3434 (e) An application requesting a variance from the standards
3535 adopted under this section must be evaluated and approved
3636 consistent with previous variances approved by the commission.
3737 SECTION 2. This Act takes effect September 1, 2021.
