66 AN ACT
77 relating to the creation of the office of forensic services within
88 the Department of State Health Services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle A, Title 7, Health and Safety Code, is
1111 amended by adding Chapter 535 to read as follows:
1212 CHAPTER 535. OFFICE OF FORENSIC SERVICES
1313 Sec. 535.001. DEFINITIONS. In this chapter:
1414 (1) "Forensic patient" and "forensic services" have
1515 the meanings assigned by Section 532.013.
1616 (2) "Office" means the office of forensic services
1717 established within the department under this chapter.
1818 Sec. 535.002. ESTABLISHMENT; PURPOSE. (a) The office is
1919 established as an office within the department.
2020 (b) The office is created to ensure a strategic statewide
2121 approach to the provision of forensic services. The office shall
2222 have input into policy, service delivery, funding, and commission
2323 or department rulemaking regarding the provision of forensic
2424 services to ensure a comprehensive, integrated, and strategic
2525 systems-level approach to forensic services.
2626 (c) The forensic director appointed under Section 532.013
2727 shall oversee the office.
2828 Sec. 535.003. POWERS AND DUTIES. (a) The office shall:
2929 (1) coordinate and streamline internal commission
3030 processes and forensic services by:
3131 (A) monitoring and providing oversight to the
3232 processes;
3333 (B) providing clinical leadership; and
3434 (C) collecting data related to forensic services
3535 to improve the provision of those services;
3636 (2) develop a statewide strategic forensic plan as an
3737 addendum to the statewide behavioral health strategic plan to
3838 address the needs of forensic patients;
3939 (3) develop best practices for inpatient policies and
4040 procedures relating to the provision of forensic services;
4141 (4) review and consult on all commission contracts
4242 related to the provision of forensic services, diversion efforts,
4343 and crisis services;
4444 (5) review and consult on all commission contracts for
4545 outpatient and jail-based competency restoration programs;
4646 (6) examine local initiatives related to the provision
4747 of forensic services;
4848 (7) evaluate the success of local initiatives
4949 described by Subdivision (6) and, based on that evaluation, develop
5050 and implement a plan to expand successful local initiatives to
5151 other areas in this state, including scaling those initiatives for
5252 use in state facilities licensed under Subtitle B and by other
5353 forensic services providers;
5454 (8) develop special initiatives at the local, state,
5555 and federal level;
5656 (9) provide support to the department's Joint
5757 Committee on Access and Forensic Services in the development of
5858 policy and legislative proposals for the improvement of forensic
5959 services in this state;
6060 (10) provide training and technical assistance to:
6161 (A) local mental health authorities;
6262 (B) local behavioral health authorities
6363 designated under Section 533.0356;
6464 (C) staff members of courts with jurisdiction
6565 over forensic patients;
6666 (D) county jails; and
6767 (E) law enforcement officers;
6868 (11) direct and coordinate data analysis to:
6969 (A) improve the efficiency of forensic service
7070 commission programs; and
7171 (B) evaluate forensic services programs in this
7272 state;
7373 (12) develop and maintain a comprehensive statewide
7474 registry of forensic hospital bed availability and competency
7575 restoration services;
7676 (13) develop a coordinated statewide system of
7777 forensic service information and technical assistance;
7878 (14) identify strategies to maximize competency
7979 restoration programs across this state; and
8080 (15) develop and implement strategies to address the
8181 increasing demands on the forensic system.
8282 (b) As part of the office's duties, the office must collect
8383 and analyze data regarding:
8484 (1) patient outcomes from behavioral health services
8585 and programs for individuals with intellectual and developmental
8686 disabilities, including data from:
8787 (A) the grant program established under Section
8888 531.0993, Government Code;
8989 (B) outpatient competency restoration service
9090 providers;
9191 (C) jail-based competency restoration providers;
9292 and
9393 (D) the Harris County Mental Health Jail
9494 Diversion Program;
9595 (2) the length of time it takes an individual to
9696 receive inpatient competency restoration services;
9797 (3) the length of time it takes an individual to
9898 receive forensic services; and
9999 (4) the means by which forensic patients and
100100 justice-involved individuals are receiving forensic services.
101101 SECTION 2. Not later than December 1, 2021, the
102102 commissioner of state health services shall establish the office of
103103 forensic services within the Department of State Health Services as
104104 required by Chapter 535, Health and Safety Code, as added by this
105105 Act.
106106 SECTION 3. This Act takes effect September 1, 2021.
