7 | 9 | | Department of State Health Services. |

8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 11 | | SECTION 1. Section 161.0074, Health and Safety Code, is |
---|
10 | 12 | | amended by adding Subsection (d) to read as follows: |
---|
11 | 13 | | (d) If a public health disaster was declared under Chapter |
---|
12 | 14 | | 81 during the preceding two years, in addition to the information |
---|
13 | 15 | | required under Subsection (c), for immunizations that immunize an |
---|
14 | 16 | | individual against the communicable disease subject to the |
---|
15 | 17 | | declaration the report must: |
---|
16 | 18 | | (1) include information by county on the accessibility |
---|
17 | 19 | | to the immunizations of county residents by age, race, and |
---|
18 | 20 | | geographic location, provided the information does not personally |
---|
19 | 21 | | identify any individual; |
---|
20 | 22 | | (2) identify and assess disparities in access to the |
---|
21 | 23 | | immunizations by age, race, and geographic location, including an |
---|
22 | 24 | | assessment of immunization accessibility in each county; |
---|
23 | 25 | | (3) include the estimated economic benefit to this |
---|
24 | 26 | | state of reducing disparities in immunization accessibility; |
---|
25 | 27 | | (4) include recommendations for reducing disparities |
---|
26 | 28 | | in immunization accessibility; and |
---|
27 | 29 | | (5) include recommendations for legislative action to |
---|
28 | 30 | | increase immunization rates. |

29 | 31 | | SECTION 2. Section 161.008, Health and Safety Code, is |
---|
30 | 32 | | amended by adding Subsection (b-1) to read as follows: |
---|
31 | 33 | | (b-1) An immunization record provided by a health care |
---|
32 | 34 | | provider as required by Section 161.00705 for inclusion in the |
---|
33 | 35 | | immunization registry during a public health disaster declared |
---|
34 | 36 | | under Chapter 81 must contain the race, age, ethnicity, and county |
---|
35 | 37 | | of residence of the individual immunized. This subsection applies |
---|
36 | 38 | | only to immunizations that immunize an individual against the |
---|
37 | 39 | | communicable disease subject to the declaration. |
---|
38 | 40 | | SECTION 3. This Act takes effect immediately if it receives |
---|
39 | 41 | | a vote of two-thirds of all the members elected to each house, as |
---|
40 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
41 | 43 | | Act does not receive the vote necessary for immediate effect, this |
---|
42 | 44 | | Act takes effect September 1, 2021. |
