5+ A BILL TO BE ENTITLED
46 AN ACT
57 relating to the content of certain immunization records and of
68 certain biennial legislative reports on immunizations issued by the
79 Department of State Health Services.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 161.0074, Health and Safety Code, is
1012 amended by adding Subsection (d) to read as follows:
1113 (d) If a public health disaster was declared under Chapter
1214 81 during the preceding two years, in addition to the information
1315 required under Subsection (c), for immunizations that immunize an
1416 individual against the communicable disease subject to the
1517 declaration the report must:
1618 (1) include information by county on the accessibility
1719 to the immunizations of county residents by age, race, and
1820 geographic location, provided the information does not personally
1921 identify any individual;
2022 (2) identify and assess disparities in access to the
2123 immunizations by age, race, and geographic location, including an
2224 assessment of immunization accessibility in each county;
2325 (3) include the estimated economic benefit to this
2426 state of reducing disparities in immunization accessibility;
2527 (4) include recommendations for reducing disparities
2628 in immunization accessibility; and
2729 (5) include recommendations for legislative action to
2830 increase immunization rates.
2931 SECTION 2. Section 161.008, Health and Safety Code, is
3032 amended by adding Subsection (b-1) to read as follows:
3133 (b-1) An immunization record provided by a health care
3234 provider as required by Section 161.00705 for inclusion in the
3335 immunization registry during a public health disaster declared
3436 under Chapter 81 must contain the race, age, ethnicity, and county
3537 of residence of the individual immunized. This subsection applies
3638 only to immunizations that immunize an individual against the
3739 communicable disease subject to the declaration.
3840 SECTION 3. This Act takes effect immediately if it receives
3941 a vote of two-thirds of all the members elected to each house, as
4042 provided by Section 39, Article III, Texas Constitution. If this
4143 Act does not receive the vote necessary for immediate effect, this
4244 Act takes effect September 1, 2021.
