5+ A BILL TO BE ENTITLED
46 AN ACT
57 relating to the reporting of certain incidents of sexual
68 harassment, sexual assault, dating violence, or stalking at certain
79 public or private institutions of higher education.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 51.252, Education Code, is amended by
1012 amending Subsection (b) and adding Subsection (c-1) to read as
1113 follows:
1214 (b) Except as provided by Subsection (c) or (c-1), the
1315 report must include all information concerning the incident known
1416 to the reporting person that is relevant to the investigation and,
1517 if applicable, redress of the incident, including whether an
1618 alleged victim has expressed a desire for confidentiality in
1719 reporting the incident.
1820 (c-1) A campus peace officer employed by a postsecondary
1921 educational institution who receives information regarding an
2022 incident described by Subsection (a) from an alleged victim who
2123 chooses to complete a pseudonym form described by Article 58.102,
2224 58.152, 58.202, or 58.252, Code of Criminal Procedure, shall, in
2325 making a report under this section, state only the type of incident
2426 reported and may not include the victim's name, phone number,
2527 address, or other information that may directly or indirectly
2628 reveal the victim's identity.
2729 SECTION 2. Section 51.256(c), Education Code, is amended to
2830 read as follows:
2931 (c) Nothing in this section may be construed as prohibiting
3032 a victim from making a report to a law enforcement agency using a
3133 [the] pseudonym form described by Article 58.102, 58.152, 58.202,
3234 or 58.252 [57.02], Code of Criminal Procedure.
3335 SECTION 3. To the extent of any conflict, this Act prevails
3436 over another Act of the 87th Legislature, Regular Session, 2021,
3537 relating to nonsubstantive additions to and corrections in enacted
3638 codes.
3739 SECTION 4. This Act takes effect immediately if it receives
3840 a vote of two-thirds of all the members elected to each house, as
3941 provided by Section 39, Article III, Texas Constitution. If this
4042 Act does not receive the vote necessary for immediate effect, this
4143 Act takes effect September 1, 2021.
