7 | 9 | | public or private institutions of higher education. |

8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 11 | | SECTION 1. Section 51.252, Education Code, is amended by |
---|
10 | 12 | | amending Subsection (b) and adding Subsection (c-1) to read as |
---|
11 | 13 | | follows: |
---|
12 | 14 | | (b) Except as provided by Subsection (c) or (c-1), the |
---|
13 | 15 | | report must include all information concerning the incident known |
---|
14 | 16 | | to the reporting person that is relevant to the investigation and, |
---|
15 | 17 | | if applicable, redress of the incident, including whether an |
---|
16 | 18 | | alleged victim has expressed a desire for confidentiality in |
---|
17 | 19 | | reporting the incident. |
---|
18 | 20 | | (c-1) A campus peace officer employed by a postsecondary |
---|
19 | 21 | | educational institution who receives information regarding an |
---|
20 | 22 | | incident described by Subsection (a) from an alleged victim who |
---|
21 | 23 | | chooses to complete a pseudonym form described by Article 58.102, |
---|
22 | 24 | | 58.152, 58.202, or 58.252, Code of Criminal Procedure, shall, in |
---|
23 | 25 | | making a report under this section, state only the type of incident |
---|
24 | 26 | | reported and may not include the victim's name, phone number, |
---|
25 | 27 | | address, or other information that may directly or indirectly |
---|
26 | 28 | | reveal the victim's identity. |
---|
27 | 29 | | SECTION 2. Section 51.256(c), Education Code, is amended to |
---|
28 | 30 | | read as follows: |
---|
29 | 31 | | (c) Nothing in this section may be construed as prohibiting |
---|
30 | 32 | | a victim from making a report to a law enforcement agency using a |
---|
31 | 33 | | [the] pseudonym form described by Article 58.102, 58.152, 58.202, |
---|
32 | 34 | | or 58.252 [57.02], Code of Criminal Procedure. |
---|
33 | 35 | | SECTION 3. To the extent of any conflict, this Act prevails |
---|
34 | 36 | | over another Act of the 87th Legislature, Regular Session, 2021, |
---|
35 | 37 | | relating to nonsubstantive additions to and corrections in enacted |
---|
36 | 38 | | codes. |
---|
37 | 39 | | SECTION 4. This Act takes effect immediately if it receives |
---|
38 | 40 | | a vote of two-thirds of all the members elected to each house, as |
---|
39 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
40 | 42 | | Act does not receive the vote necessary for immediate effect, this |
---|
41 | 43 | | Act takes effect September 1, 2021. |
