55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the administration, implementation, and enforcement of
88 federal produce safety standards by the Department of Agriculture.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 91.009, Agriculture Code, is amended by
1111 amending Subsections (a) and (c-1) and adding Subsections (e) and
1212 (f) to read as follows:
1313 (a) The department shall administer, implement, and enforce
1414 in this state [is the lead agency for the administration,
1515 implementation, and enforcement of, and education and training
1616 relating to,] the United States Food and Drug Administration
1717 Standards for the Growing, Harvesting, Packing, and Holding of
1818 Produce for Human Consumption (21 C.F.R. Part 112) or any successor
1919 federal produce safety rule or standard. This section does not
2020 authorize the department to implement or enforce any other federal
2121 regulation.
2222 (c-1) The department may enter into a cooperative
2323 agreement, interagency agreement, grant agreement, or memorandum
2424 of understanding with a federal or state agency as necessary to
2525 carry out the department's [for the] administration,
2626 implementation, or enforcement of this section.
2727 (e) With respect to a farm that is not subject to the federal
2828 rules or standards described by Subsection (a) because the farm
2929 does not generate more than the threshold amount of revenue from the
3030 sale of produce to be a covered farm, the department:
3131 (1) may not use the authority granted by this section
3232 as justification to physically enter the farm;
3333 (2) is limited to inquiring about whether the farm
3434 generates more than the threshold amount of revenue from the sale of
3535 produce to be a covered farm; and
3636 (3) may not conduct further investigative activity
3737 after receiving documentation indicating the farm generates less
3838 than the threshold amount of revenue from the sale of produce to be
3939 a covered farm.
4040 (f) The department's rules may not impose additional or more
4141 burdensome requirements than those provided by the federal rules or
4242 standards described by Subsection (a). Specifically, the
4343 department may not:
4444 (1) require registration of a farm that is not covered
4545 by, is exempt from, or is eligible for a qualified exemption from
4646 the rules or standards;
4747 (2) without probable cause that the farm is violating
4848 an applicable law, conduct a physical inspection of a farm that is
4949 not covered by, is exempt from, or is eligible for a qualified
5050 exemption from the rules or standards; or
5151 (3) create a new or different standard, including a
5252 standard for imposing penalties, that is not contained in the
5353 federal rules or standards.
5454 SECTION 2. This Act takes effect immediately if it receives
5555 a vote of two-thirds of all the members elected to each house, as
5656 provided by Section 39, Article III, Texas Constitution. If this
5757 Act does not receive the vote necessary for immediate effect, this
5858 Act takes effect September 1, 2021.
