55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to eliminating certain restrictions on eligibility for
88 certain state student financial assistance programs.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 54.633(b), Education Code, is amended to
1111 read as follows:
1212 (b) A scholarship awarded under this section terminates if
1313 the student to whom the scholarship is awarded is[:
1414 [(1) convicted of, or adjudicated as having engaged in
1515 delinquent conduct constituting, an offense under Chapter 481,
1616 Health and Safety Code; or
1717 [(2)] convicted of, or adjudicated as having engaged
1818 in delinquent conduct constituting, a felony or Class A
1919 misdemeanor.
2020 SECTION 2. Section 56.304(b), Education Code, is amended to
2121 read as follows:
2222 (b) A person is not eligible to receive a TEXAS grant if the
2323 person has been convicted of a felony [or an offense under Chapter
2424 481, Health and Safety Code (Texas Controlled Substances Act), or
2525 under the law of another jurisdiction involving a controlled
2626 substance as defined by Chapter 481, Health and Safety Code],
2727 unless the person has met the other applicable eligibility
2828 requirements under this subchapter and has:
2929 (1) received a certificate of discharge by the Texas
3030 Department of Criminal Justice or a correctional facility or
3131 completed a period of probation ordered by a court, and at least two
3232 years have elapsed from the date of the receipt or completion; or
3333 (2) been pardoned, had the record of the offense
3434 expunged from the person's record, or otherwise has been released
3535 from the resulting ineligibility to receive a grant under this
3636 subchapter.
3737 SECTION 3. Section 56.305(b), Education Code, is amended to
3838 read as follows:
3939 (b) A person is not eligible to continue to receive a TEXAS
4040 grant under this section if the person has been convicted of a
4141 felony [or an offense under Chapter 481, Health and Safety Code
4242 (Texas Controlled Substances Act), or under the law of another
4343 jurisdiction involving a controlled substance as defined by Chapter
4444 481, Health and Safety Code], unless the person has met the other
4545 applicable eligibility requirements under this subchapter and has:
4646 (1) received a certificate of discharge by the Texas
4747 Department of Criminal Justice or a correctional facility or
4848 completed a period of probation ordered by a court, and at least two
4949 years have elapsed from the date of the receipt or completion; or
5050 (2) been pardoned, had the record of the offense
5151 expunged from the person's record, or otherwise has been released
5252 from the resulting ineligibility to receive a grant under this
5353 subchapter.
5454 SECTION 4. Section 56.357(c), Education Code, is amended to
5555 read as follows:
5656 (c) A person is not eligible to receive a grant under the
5757 program if the person has been convicted of a felony [or an offense
5858 under Chapter 481, Health and Safety Code (Texas Controlled
5959 Substances Act), or under the law of another jurisdiction involving
6060 a controlled substance, as defined by Chapter 481, Health and
6161 Safety Code], unless the person has met the other applicable
6262 eligibility requirements under this section and has:
6363 (1) received a certificate of discharge by the Texas
6464 Department of Criminal Justice or a correctional facility or
6565 completed a period of probation ordered by a court, and at least two
6666 years have elapsed from the date of the receipt or completion; or
6767 (2) been pardoned, had the record of the offense
6868 expunged from the person's record, or otherwise has been released
6969 from the resulting ineligibility to receive a grant under the
7070 program.
7171 SECTION 5. Section 56.404(b), Education Code, is amended to
7272 read as follows:
7373 (b) A person is not eligible to receive a grant under this
7474 subchapter if the person has been convicted of a felony [or an
7575 offense under Chapter 481, Health and Safety Code (Texas Controlled
7676 Substances Act), or under the law of another jurisdiction involving
7777 a controlled substance as defined by Chapter 481, Health and Safety
7878 Code], unless the person has met the other applicable eligibility
7979 requirements under this subchapter and has:
8080 (1) received a certificate of discharge by the Texas
8181 Department of Criminal Justice or a correctional facility or
8282 completed a period of probation ordered by a court and at least two
8383 years have elapsed from the date of the receipt or completion; or
8484 (2) been pardoned, had the record of the offense
8585 expunged from the person's record, or otherwise been released from
8686 the resulting ineligibility to receive a grant under this
8787 subchapter.
8888 SECTION 6. Section 56.405(b), Education Code, is amended to
8989 read as follows:
9090 (b) A person is not eligible to continue to receive a grant
9191 under this section if the person has been convicted of a felony [or
9292 an offense under Chapter 481, Health and Safety Code (Texas
9393 Controlled Substances Act), or under the law of another
9494 jurisdiction involving a controlled substance as defined by Chapter
9595 481, Health and Safety Code], unless the person has met the other
9696 applicable eligibility requirements under this subchapter and has:
9797 (1) received a certificate of discharge by the Texas
9898 Department of Criminal Justice or a correctional facility or
9999 completed a period of probation ordered by a court and at least two
100100 years have elapsed from the date of the receipt or completion; or
101101 (2) been pardoned, had the record of the offense
102102 expunged from the person's record, or otherwise been released from
103103 the resulting ineligibility to receive a grant under this
104104 subchapter.
105105 SECTION 7. This Act takes effect immediately if it receives
106106 a vote of two-thirds of all the members elected to each house, as
107107 provided by Section 39, Article III, Texas Constitution. If this
108108 Act does not receive the vote necessary for immediate effect, this
109109 Act takes effect September 1, 2021.
