| 9 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 9 | | SECTION 1. Subtitle D, Title 2, Labor Code, is amended by |
|---|
| 11 | 10 | | adding Chapter 83 to read as follows: |
|---|
| 12 | 11 | | CHAPTER 83. PROHIBITION AGAINST LOCAL REGULATION OF EMPLOYMENT |
|---|
| 13 | 12 | | BENEFITS AND POLICIES |
|---|
| 14 | 13 | | Sec. 83.001. DEFINITIONS. In this chapter: |
|---|
| 15 | 14 | | (1) "Employee" means an individual who is employed by |
|---|
| 16 | 15 | | an employer for compensation. |
|---|
| 17 | 16 | | (2) "Employer" means a person who employs one or more |
|---|
| 18 | 17 | | employees. |
|---|
| 19 | 18 | | (3) "Employment benefit" means anything of value that |
|---|
| 20 | 19 | | an employee receives from an employer beyond regular salary or |
|---|
| 21 | 20 | | wages. |
|---|
| 22 | 21 | | Sec. 83.002. PROHIBITION AGAINST MUNICIPALITY OR COUNTY |
|---|
| 23 | 22 | | REQUIRING CERTAIN EMPLOYMENT BENEFITS OR POLICIES. (a) A |
|---|
| 24 | 23 | | municipality or county may not adopt or enforce an ordinance, |
|---|
| 25 | 24 | | order, rule, regulation, or policy requiring any terms of |
|---|
| 26 | 25 | | employment that exceed or conflict with federal or state law |
|---|
| 27 | 26 | | relating to any form of employment leave, hiring practices, |
|---|
| 28 | 27 | | employment benefits, scheduling practices, or other terms of |
|---|
| 29 | 28 | | employment. |
|---|
| 30 | 29 | | (b) Any provision of an ordinance, order, rule, regulation, |
|---|
| 31 | 30 | | or policy that violates Subsection (a) is void and unenforceable. |
|---|
| 32 | 31 | | (c) This chapter does not affect: |
|---|
| 33 | 32 | | (1) the Texas Minimum Wage Act under Chapter 62; |
|---|
| 34 | 33 | | (2) the authority of a political subdivision to |
|---|
| 35 | 34 | | negotiate the terms of employment with the political subdivision's |
|---|
| 36 | 35 | | employees; |
|---|
| 37 | 36 | | (3) an ordinance, order, rule, regulation, or policy |
|---|
| 38 | 37 | | relating to terms of employment in contracts or agreements entered |
|---|
| 39 | 38 | | into between a private entity, including an organization |
|---|
| 40 | 39 | | representing city employees or county employees, and a governmental |
|---|
| 41 | 40 | | entity, regardless of whether the ordinance, order, rule, |
|---|
| 42 | 41 | | regulation, or policy is adopted before, on, or after September 1, |
|---|
| 43 | 42 | | 2021; or |
|---|
| 44 | 43 | | (4) a contract or agreement relating to terms of |
|---|
| 45 | 44 | | employment voluntarily entered into between a private employer or |
|---|
| 46 | 45 | | entity and a governmental entity. |
|---|
| 47 | 46 | | SECTION 2. Chapter 83, Labor Code, as added by this Act, |
|---|
| 48 | 47 | | applies to an ordinance, order, rule, regulation, or policy adopted |
|---|
| 49 | 48 | | before, on, or after the effective date of this Act. |
|---|
| 50 | 49 | | SECTION 3. This Act takes effect September 1, 2021. |
