98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. Subtitle D, Title 2, Labor Code, is amended by
1110 adding Chapter 83 to read as follows:
1211 CHAPTER 83. PROHIBITION AGAINST LOCAL REGULATION OF EMPLOYMENT
1312 BENEFITS AND POLICIES
1413 Sec. 83.001. DEFINITIONS. In this chapter:
1514 (1) "Employee" means an individual who is employed by
1615 an employer for compensation.
1716 (2) "Employer" means a person who employs one or more
1817 employees.
1918 (3) "Employment benefit" means anything of value that
2019 an employee receives from an employer beyond regular salary or
2120 wages.
2221 Sec. 83.002. PROHIBITION AGAINST MUNICIPALITY OR COUNTY
2322 REQUIRING CERTAIN EMPLOYMENT BENEFITS OR POLICIES. (a) A
2423 municipality or county may not adopt or enforce an ordinance,
2524 order, rule, regulation, or policy requiring any terms of
2625 employment that exceed or conflict with federal or state law
2726 relating to any form of employment leave, hiring practices,
2827 employment benefits, scheduling practices, or other terms of
2928 employment.
3029 (b) Any provision of an ordinance, order, rule, regulation,
3130 or policy that violates Subsection (a) is void and unenforceable.
3231 (c) This chapter does not affect:
3332 (1) the Texas Minimum Wage Act under Chapter 62;
3433 (2) the authority of a political subdivision to
3534 negotiate the terms of employment with the political subdivision's
3635 employees;
3736 (3) an ordinance, order, rule, regulation, or policy
3837 relating to terms of employment in contracts or agreements entered
3938 into between a private entity, including an organization
4039 representing city employees or county employees, and a governmental
4140 entity, regardless of whether the ordinance, order, rule,
4241 regulation, or policy is adopted before, on, or after September 1,
4342 2021; or
4443 (4) a contract or agreement relating to terms of
4544 employment voluntarily entered into between a private employer or
4645 entity and a governmental entity.
4746 SECTION 2. Chapter 83, Labor Code, as added by this Act,
4847 applies to an ordinance, order, rule, regulation, or policy adopted
4948 before, on, or after the effective date of this Act.
5049 SECTION 3. This Act takes effect September 1, 2021.
