77 relating to the labeling of wine as originating from an area of this
88 state.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 101, Alcoholic Beverage
1111 Code, is amended by adding Section 101.673 to read as follows:
1212 Sec. 101.673. USE OF TEXAS APPELLATION OF ORIGIN: AMERICAN
1313 VITICULTURAL AREA OR COUNTY. (a) In this section, "American
1414 viticultural area" has the meaning assigned by 27 C.F.R. Section
1515 4.25.
1616 (b) A wine that is otherwise entitled under federal law to
1717 an appellation of origin indicating the wine's origin is an
1818 American viticultural area or county located in this state may use
1919 that appellation only if the wine is:
2020 (1) 100 percent by volume fermented juice of grapes or
2121 other fruit grown in this state;
2222 (2) not less than 90 percent by volume fermented juice
2323 of grapes grown within the boundaries of the labeled American
2424 viticultural area or county; and
2525 (3) fully produced in this state.
2626 SECTION 2. The change in law made by this Act applies only
2727 to a wine labeled on or after the effective date of this Act.
2828 SECTION 3. This Act takes effect September 1, 2021.
