9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter D, Chapter 101, Alcoholic Beverage | |
11 | 11 | Code, is amended by adding Section 101.673 to read as follows: | |
12 | 12 | Sec. 101.673. USE OF TEXAS APPELLATION OF ORIGIN: AMERICAN | |
13 | 13 | VITICULTURAL AREA OR COUNTY. (a) In this section, "American | |
14 | 14 | viticultural area" has the meaning assigned by 27 C.F.R. Section | |
15 | 15 | 4.25. | |
16 | 16 | (b) A wine that is otherwise entitled under federal law to | |
17 | 17 | an appellation of origin indicating the wine's origin is an | |
18 | 18 | American viticultural area or county located in this state may use | |
19 | 19 | that appellation only if the wine is: | |
20 | 20 | (1) 100 percent by volume fermented juice of grapes or | |
21 | 21 | other fruit grown in this state; | |
22 | 22 | (2) not less than 90 percent by volume fermented juice | |
23 | 23 | of grapes grown within the boundaries of the labeled American | |
24 | 24 | viticultural area or county; and | |
25 | 25 | (3) fully produced in this state. | |
26 | 26 | SECTION 2. The change in law made by this Act applies only | |
27 | 27 | to a wine labeled on or after the effective date of this Act. | |
28 | 28 | SECTION 3. This Act takes effect September 1, 2021. |
