77 relating to the certification of live music venues by and other
88 duties of the Texas Music Office.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 485, Government Code, is amended by
1111 adding Subchapter C to read as follows:
1212 SUBCHAPTER C. TEXAS MUSIC OFFICE
1313 Sec. 485.051. DEFINITIONS. In this subchapter:
1414 (1) "Certification holder" means an individual or
1515 entity that holds a certification issued by the music office as an
1616 independent live music venue, operator, producer, or promoter under
1717 this subchapter.
1818 (2) "Music office" means the Texas Music Office in the
1919 office of the governor.
2020 Sec. 485.052. DUTIES. The music office shall:
2121 (1) administer and oversee federal programs in this
2222 state supporting independent live music venues, operators,
2323 producers, or promoters, including monitoring changes to those
2424 programs to ensure efficient implementation;
2525 (2) in accordance with Section 485.053, issue
2626 certifications to independent live music venues, operators,
2727 producers, and promoters for the purpose of administering and
2828 overseeing programs described by Subdivision (1); and
2929 (3) ensure each certification holder maintains
3030 compliance with the requirements for certification under this
3131 subchapter.
3232 Sec. 485.053. CERTIFICATION ISSUANCE. (a) Subject to
3333 Subsections (b) and (c), the music office shall issue a
3434 certification as an independent live music venue, operator,
3535 producer, or promoter, for purposes of any federal program
3636 requiring such certification, to an individual or entity that:
3737 (1) organizes, promotes, sells tickets, produces,
3838 manages, or hosts live concerts;
3939 (2) generates at least 60 percent of the individual's
4040 or entity's primary business revenue from:
4141 (A) entrance fees or ticket sales and fees;
4242 (B) production reimbursements; and
4343 (C) the sale of beverages, food, and merchandise
4444 at events;
4545 (3) has operated its primary business in this state
4646 for at least one year preceding certification;
4747 (4) pays artists fairly in an amount that is:
4848 (A) based on:
4949 (i) a percentage of sales;
5050 (ii) a guarantee in writing or in a standard
5151 contract; or
5252 (iii) any other mutually beneficial formal
5353 agreement; and
5454 (B) not based solely on tips, unless the artist
5555 is participating in a legitimate fundraiser or similar charitable
5656 event; and
5757 (5) meets at least five of the following criteria:
5858 (A) markets live music performances through
5959 listings in printed or electronic publications;
6060 (B) provides live music performances four or more
6161 nights of each week;
6262 (C) employs or contracts the services of one or
6363 more persons in two or more of the following positions or services:
6464 (i) sound engineer;
6565 (ii) booker;
6666 (iii) promoter;
6767 (iv) stage manager; or
6868 (v) security personnel;
6969 (D) has designated live performance and audience
7070 space;
7171 (E) provides technical sound and lighting,
7272 either in-house or through a contract with a vendor;
7373 (F) has a dedicated space for the storage of
7474 audio equipment or musical instruments;
7575 (G) charges for live music performances through
7676 ticketing or imposing an entrance fee; or
7777 (H) maintains hours of operation that coincide
7878 with live music performance show times.
7979 (b) The music office may not issue a certification as an
8080 independent live music venue, operator, producer, or promoter to an
8181 individual or entity that:
8282 (1) presents live performances of a prurient sexual
8383 nature, as determined by the music office; or
8484 (2) derives directly or indirectly a more than de
8585 minimis gross revenue, as determined by the music office, through:
8686 (A) the sale of products or services of a
8787 prurient sexual nature; or
8888 (B) the presentation of any depictions or
8989 displays of a prurient sexual nature.
9090 (c) The music office may not issue a certification as an
9191 independent live music venue, operator, producer, or promoter to an
9292 individual or entity unless the individual or entity:
9393 (1) employs as full-time equivalents 50 or more
9494 employees or contractors;
9595 (2) derives not less than 10 percent of the
9696 individual's or entity's gross revenue from federal funding; or
9797 (3) is majority-owned, controlled, or operated by an
9898 individual or entity described by Subdivisions (1) and (2).
9999 SECTION 2. This Act takes effect September 1, 2021.
