46 AN ACT
57 relating to the time frame for passing certain licensing
68 examinations for applicants seeking a license to practice medicine.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 155.051(b), Occupations Code, is amended
911 to read as follows:
1012 (b) An applicant who is a graduate of a program designed to
1113 lead to both a doctor of philosophy degree and a doctor of medicine
1214 degree or doctor of osteopathy degree must pass each part of an
1315 examination described by Section 155.0511(2), (3), (4), (6), or (7)
1416 not later than the earlier of the second anniversary of the date the
1517 applicant completed all [the] graduate medical training undertaken
1618 by the applicant, including internship, residency, and fellowship,
1719 or the 12th anniversary of the date the applicant began the graduate
1820 medical training [described by Section 155.003(a)(5)].
1921 SECTION 2. As soon as practicable after the effective date
2022 of this Act, the Texas Medical Board shall adopt rules necessary to
2123 implement Section 155.051, Occupations Code, as amended by this
2224 Act.
2325 SECTION 3. Section 155.051, Occupations Code, as amended by
2426 this Act, applies to an application for a license to practice
2527 medicine issued under Chapter 155, Occupations Code, regardless of
2628 whether the application is submitted before, on, or after the
2729 effective date of this Act.
2830 SECTION 4. This Act takes effect immediately if it receives
2931 a vote of two-thirds of all the members elected to each house, as
3032 provided by Section 39, Article III, Texas Constitution. If this
3133 Act does not receive the vote necessary for immediate effect, this
3234 Act takes effect September 1, 2021.
