| 8 | 8 | | at a certain grade level for a public school student whose education |

| 9 | 9 | | was disrupted by the coronavirus disease pandemic. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter B, Chapter 28, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 28.02124 to read as follows: |
|---|
| 13 | 13 | | Sec. 28.02124. OPTIONAL GRADE LEVEL RETENTION OR RETURN. |
|---|
| 14 | 14 | | (a) Notwithstanding any other provision of this subchapter, due to |
|---|
| 15 | 15 | | the disruption in public education caused by the coronavirus |
|---|
| 16 | 16 | | disease (COVID-19) pandemic, a student's parent or legal guardian |
|---|
| 17 | 17 | | may request that for the 2021-2022 school year the student be |
|---|
| 18 | 18 | | returned to or retained at the grade level in which the student was |
|---|
| 19 | 19 | | enrolled during the 2020-2021 school year. |
|---|
| 20 | 20 | | (b) A school district or open-enrollment charter school |
|---|
| 21 | 21 | | shall grant a request made in accordance with Subsection (a). |
|---|
| 22 | 22 | | (c) Before the beginning of the 2021-2022 school year, each |
|---|
| 23 | 23 | | school district and open-enrollment charter school shall provide |
|---|
| 24 | 24 | | written notice regarding the option under this section to the |
|---|
| 25 | 25 | | parent or legal guardian of each student enrolled in the district or |
|---|
| 26 | 26 | | school. |
|---|
| 27 | 27 | | (d) This section expires September 1, 2022. |
|---|
| 28 | 28 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2021. |
