55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a parental option to request the return to or retention
88 at a certain grade level for a public school student whose education
99 was disrupted by the coronavirus disease pandemic.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 28, Education Code, is
1212 amended by adding Section 28.02124 to read as follows:
1313 Sec. 28.02124. OPTIONAL GRADE LEVEL RETENTION OR RETURN.
1414 (a) Notwithstanding any other provision of this subchapter, due to
1515 the disruption in public education caused by the coronavirus
1616 disease (COVID-19) pandemic, a student's parent or legal guardian
1717 may request that for the 2021-2022 school year the student be
1818 returned to or retained at the grade level in which the student was
1919 enrolled during the 2020-2021 school year.
2020 (b) A school district or open-enrollment charter school
2121 shall grant a request made in accordance with Subsection (a).
2222 (c) Before the beginning of the 2021-2022 school year, each
2323 school district and open-enrollment charter school shall provide
2424 written notice regarding the option under this section to the
2525 parent or legal guardian of each student enrolled in the district or
2626 school.
2727 (d) This section expires September 1, 2022.
2828 SECTION 2. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2021.
