| 10 | 10 | SECTION 1. Subchapter A, Chapter 623, Transportation Code, | |
| 11 | 11 | is amended by adding Section 623.009 to read as follows: | |
| 12 | 12 | Sec. 623.009. REDEDICATION OF CERTAIN REVENUE TO THE STATE | |
| 13 | 13 | HIGHWAY FUND. Notwithstanding any other law, all dedications of | |
| 14 | 14 | permit fee revenue to the state highway fund made under this chapter | |
| 15 | 15 | and Chapters 621 and 622 are rededicated to the state highway fund | |
| 16 | 16 | for the purposes of acquiring, constructing, and maintaining public | |
| 17 | 17 | roadways. | |
| 18 | 18 | SECTION 2. This Act takes effect January 1, 2022, but only | |
| 19 | 19 | if the constitutional amendment proposed by the 87th Legislature, | |
| 20 | 20 | Regular Session, 2021, constitutionally dedicating certain revenue | |
| 21 | 21 | to the state highway fund for the purposes of acquiring, | |
| 22 | 22 | constructing, and maintaining public roadways is approved by the | |
| 23 | 23 | voters. If that amendment is not approved by the voters, this Act | |
| 24 | 24 | has no effect. |
