| 7 | 7 | | relating to a study by the Texas Department of Transportation on the |
|---|
| 8 | 8 | | impact of certain classifications of motor vehicle on the roads and |
|---|
| 9 | 9 | | bridges of this state. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 11 | 11 | | SECTION 1. DEFINITION. In this Act, "department" means the |
|---|
| 12 | 12 | | Texas Department of Transportation. |
|---|
| 13 | 13 | | SECTION 2. STUDY AND REPORT. (a) The department, in |
|---|
| 14 | 14 | | consultation with the Texas A&M Transportation Institute, The |
|---|
| 15 | 15 | | University of Texas Center for Transportation Research, and |
|---|
| 16 | 16 | | transportation industry representatives, shall conduct a study on |
|---|
| 17 | 17 | | the impact on the roads and bridges of this state by motor vehicles |
|---|
| 18 | 18 | | classified as: |
|---|
| 19 | 19 | | (1) passenger vehicles; |
|---|
| 20 | 20 | | (2) commercial motor vehicles; and |
|---|
| 21 | 21 | | (3) oversize or overweight vehicles. |
|---|
| 22 | 22 | | (b) The study shall determine, for each classification of |
|---|
| 23 | 23 | | vehicle listed in Subsection (a) of this section: |
|---|
| 24 | 24 | | (1) the number of vehicles that drive on the roads and |
|---|
| 25 | 25 | | bridges of this state each year; |
|---|
| 26 | 26 | | (2) the number of miles driven on the roads and bridges |
|---|
| 27 | 27 | | of this state each year; |
|---|
| 28 | 28 | | (3) the total revenue contribution from taxes and fees |
|---|
| 29 | 29 | | to the construction and maintenance of the roads and bridges of this |
|---|
| 30 | 30 | | state; |
|---|
| 31 | 31 | | (4) the financial impact due to costs associated with: |
|---|
| 32 | 32 | | (A) construction and maintenance of the roads and |
|---|
| 33 | 33 | | bridges of this state; and |
|---|
| 34 | 34 | | (B) congestion on the roads and bridges of this |
|---|
| 35 | 35 | | state; and |
|---|
| 36 | 36 | | (5) whether and by what amount the total revenue |
|---|
| 37 | 37 | | contribution determined under Subdivision (3) of this subsection |
|---|
| 38 | 38 | | exceeds or falls short of the financial impact determined under |
|---|
| 39 | 39 | | Subdivision (4) of this subsection. |
|---|
| 40 | 40 | | (c) The study shall recommend one or more changes to |
|---|
| 41 | 41 | | existing tax or fee structures to ensure that vehicles of each |
|---|
| 42 | 42 | | classification listed under Subsection (a) of this section |
|---|
| 43 | 43 | | contribute revenue to fund the construction and maintenance of the |
|---|
| 44 | 44 | | roads and bridges of this state in an amount at least equal to the |
|---|
| 45 | 45 | | financial impact of the vehicles of that classification on those |
|---|
| 46 | 46 | | roads and bridges. The recommendations shall include: |
|---|
| 47 | 47 | | (1) specific dollar amounts for taxes and fees for |
|---|
| 48 | 48 | | each classification of vehicle; and |
|---|
| 49 | 49 | | (2) if applicable, new methods of structuring existing |
|---|
| 50 | 50 | | sources of revenue. |
|---|
| 51 | 51 | | (d) Not later than November 1, 2022, the department shall |
|---|
| 52 | 52 | | submit to the governor, the lieutenant governor, and the |
|---|
| 53 | 53 | | legislature a written report on the findings of the study. The |
|---|
| 54 | 54 | | report must include recommendations for policy and statutory |
|---|
| 55 | 55 | | changes, including any proposed legislation, that are based on the |
|---|
| 56 | 56 | | results of the study. |
|---|
| 57 | 57 | | SECTION 3. EXPIRATION. This Act expires May 1, 2023. |
|---|
| 58 | 58 | | SECTION 4. EFFECTIVE DATE. This Act takes effect September |
|---|
| 59 | 59 | | 1, 2021. |
