55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study by the Texas Department of Transportation on the
88 impact of certain classifications of motor vehicle on the roads and
99 bridges of this state.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. DEFINITION. In this Act, "department" means the
1212 Texas Department of Transportation.
1313 SECTION 2. STUDY AND REPORT. (a) The department, in
1414 consultation with the Texas A&M Transportation Institute, The
1515 University of Texas Center for Transportation Research, and
1616 transportation industry representatives, shall conduct a study on
1717 the impact on the roads and bridges of this state by motor vehicles
1818 classified as:
1919 (1) passenger vehicles;
2020 (2) commercial motor vehicles; and
2121 (3) oversize or overweight vehicles.
2222 (b) The study shall determine, for each classification of
2323 vehicle listed in Subsection (a) of this section:
2424 (1) the number of vehicles that drive on the roads and
2525 bridges of this state each year;
2626 (2) the number of miles driven on the roads and bridges
2727 of this state each year;
2828 (3) the total revenue contribution from taxes and fees
2929 to the construction and maintenance of the roads and bridges of this
3030 state;
3131 (4) the financial impact due to costs associated with:
3232 (A) construction and maintenance of the roads and
3333 bridges of this state; and
3434 (B) congestion on the roads and bridges of this
3535 state; and
3636 (5) whether and by what amount the total revenue
3737 contribution determined under Subdivision (3) of this subsection
3838 exceeds or falls short of the financial impact determined under
3939 Subdivision (4) of this subsection.
4040 (c) The study shall recommend one or more changes to
4141 existing tax or fee structures to ensure that vehicles of each
4242 classification listed under Subsection (a) of this section
4343 contribute revenue to fund the construction and maintenance of the
4444 roads and bridges of this state in an amount at least equal to the
4545 financial impact of the vehicles of that classification on those
4646 roads and bridges. The recommendations shall include:
4747 (1) specific dollar amounts for taxes and fees for
4848 each classification of vehicle; and
4949 (2) if applicable, new methods of structuring existing
5050 sources of revenue.
5151 (d) Not later than November 1, 2022, the department shall
5252 submit to the governor, the lieutenant governor, and the
5353 legislature a written report on the findings of the study. The
5454 report must include recommendations for policy and statutory
5555 changes, including any proposed legislation, that are based on the
5656 results of the study.
5757 SECTION 3. EXPIRATION. This Act expires May 1, 2023.
5858 SECTION 4. EFFECTIVE DATE. This Act takes effect September
5959 1, 2021.
