| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Sec. 508.149. INMATES INELIGIBLE FOR MANDATORY |
|---|
| 10 | 10 | | SUPERVISION. (a) An inmate may not be released to mandatory |
|---|
| 11 | 11 | | supervision if the inmate is serving a sentence for or has been |
|---|
| 12 | 12 | | previously convicted of: |
|---|
| 13 | 13 | | (1) an offense for which the judgment contains an |
|---|
| 14 | 14 | | affirmative finding under Article 42A.054(c) or (d), Code of |
|---|
| 15 | 15 | | Criminal Procedure; |
|---|
| 16 | 16 | | (2) a first degree felony or a second degree felony under |
|---|
| 17 | 17 | | Section 19.02, Penal Code; |
|---|
| 18 | 18 | | (3) a capital felony under Section 19.03, Penal Code; |
|---|
| 19 | 19 | | (4) a first degree felony or a second degree felony under |
|---|
| 20 | 20 | | Section 20.04, Penal Code; |
|---|
| 21 | 21 | | (5) an offense under Section 21.11, Penal Code; |
|---|
| 22 | 22 | | (6) a felony under Section 22.011, Penal Code; |
|---|
| 23 | 23 | | (7) a first degree felony or a second degree felony under |
|---|
| 24 | 24 | | Section 22.02, Penal Code; |
|---|
| 25 | 25 | | (8) a first degree felony under Section 22.021, Penal Code; |
|---|
| 26 | 26 | | (9) a first degree felony under Section 22.04, Penal Code; |
|---|
| 27 | 27 | | (10) a first degree felony under Section 28.02, Penal Code; |

| 28 | 28 | | (11) a second degree felony under Section 29.02, Penal Code; |

| 37 | 37 | | (19) an offense under Section 20A.02, Penal Code; |

| 38 | 38 | | (20) an offense under Section 20A.03, Penal Code; or |

| 39 | 39 | | (21) a first degree felony under Section 71.02 or 71.023, |

| 40 | 40 | | Penal Code; or |
|---|
| 41 | 41 | | (22) a second or third degree felony under Section 22.01 |
|---|
| 42 | 42 | | Assault. |

| 43 | 43 | | SECTION 2. The Board of Pardons and Paroles shall adopt a |
|---|
| 44 | 44 | | policy consistent with Section 508.149, Government Code, as amended |
|---|
| 45 | 45 | | by this Act, as soon as practicable after the effective date of this |
|---|
| 46 | 46 | | Act. |
|---|
| 47 | 47 | | SECTION 3. This Act takes effect September 1, 2021. |
