55 AN ACT
66 relating to the prevention of fraud in the conduct of an election.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Sections 276.013(a) and (b), Election Code, is
99 amended to read as follows:
1010 Sec. 276.013. ELECTION FRAUD. (a) A person commits an
1111 offense if the person knowingly or intentionally makes any effort
1212 to:
1313 (1) influence the independent exercise of the vote of
1414 another in the presence of the ballot or during the voting process;
1515 (2) cause a voter to become registered, a ballot to be
1616 obtained, or a vote to be cast under false pretenses; [or]
1717 (3) count invalid votes or alter a report to include
1818 invalid votes;
1919 (4) fail to count valid votes or alter a report to
2020 exclude valid votes; or
2121 [(3)] (5) cause any intentionally misleading
2222 statement, representation, or information to be provided:
2323 (A) to an election official; or
2424 (B) on an application for ballot by mail, carrier
2525 envelope, or any other official election-related form or document.
2626 (b) An offense under this section is a [Class A misdemeanor]
2727 felony of the second degree.
2828 SECTION 2. This Act takes effect September 1, 2021.
