7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
8 | 8 | SECTION 1. Sections 276.013(a) and (b), Election Code, is | |
9 | 9 | amended to read as follows: | |
10 | 10 | Sec. 276.013. ELECTION FRAUD. (a) A person commits an | |
11 | 11 | offense if the person knowingly or intentionally makes any effort | |
12 | 12 | to: | |
13 | 13 | (1) influence the independent exercise of the vote of | |
14 | 14 | another in the presence of the ballot or during the voting process; | |
15 | 15 | (2) cause a voter to become registered, a ballot to be | |
16 | 16 | obtained, or a vote to be cast under false pretenses; [or] | |
17 | 17 | (3) count invalid votes or alter a report to include | |
18 | 18 | invalid votes; | |
19 | 19 | (4) fail to count valid votes or alter a report to | |
20 | 20 | exclude valid votes; or | |
21 | 21 | [(3)] (5) cause any intentionally misleading | |
22 | 22 | statement, representation, or information to be provided: | |
23 | 23 | (A) to an election official; or | |
24 | 24 | (B) on an application for ballot by mail, carrier | |
25 | 25 | envelope, or any other official election-related form or document. | |
26 | 26 | (b) An offense under this section is a [Class A misdemeanor] | |
27 | 27 | felony of the second degree. | |
28 | 28 | SECTION 2. This Act takes effect September 1, 2021. |
