65 AN ACT
76 relating to the adjustment of the average daily attendance of a
87 school district on the basis of a calamity.
98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. Section 48.005(d), Education Code, is amended to
1110 read as follows:
1211 (d) The commissioner may adjust the average daily
1312 attendance of a school district in which a disaster, flood, extreme
1413 weather condition, fuel curtailment, or other calamity has a
1514 significant effect on the district's attendance. In addition to
1615 providing the adjustment for the amount of instructional days
1716 during the semester in which the calamity first occurred, an
1817 adjustment under this section may only be provided based on a
1918 particular calamity for an additional amount of instructional days
2019 equivalent to one school year. The commissioner may divide the
2120 adjustment between two consecutive school years.
2221 SECTION 2. This Act takes effect September 1, 2021.
