66 AN ACT
77 relating to the reimbursement of certain urban teaching hospitals
88 for the provision of inpatient hospital care under Medicaid.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1111 is amended by adding Section 32.0285 to read as follows:
1212 Sec. 32.0285. CALCULATION OF MEDICAL EDUCATION ADD-ON FOR
1313 REIMBURSEMENT OF CERTAIN URBAN TEACHING HOSPITALS. (a) In this
1414 section:
1515 (1) "Base standard dollar amount" means the
1616 standardized payment amount calculated by the commission for costs
1717 incurred by prospectively paid hospitals in this state for
1818 providing inpatient hospital care under Medicaid.
1919 (2) "Children's hospital" means a hospital designated
2020 by the Centers for Medicare and Medicaid Services as a children's
2121 hospital.
2222 (3) "Medical education add-on" means an adjustment to
2323 the base standard dollar amount for an urban teaching hospital to
2424 reflect higher patient care costs relative to nonteaching urban
2525 hospitals.
2626 (4) "Rural hospital" means a hospital enrolled as a
2727 Medicaid provider that:
2828 (A) is located in a county with a population of
2929 not more than 60,000;
3030 (B) is designated by the Centers for Medicare and
3131 Medicaid Services as a critical access hospital, sole community
3232 hospital, or rural referral center and is not located in an area
3333 defined by the United States Office of Management and Budget as a
3434 metropolitan statistical area; or
3535 (C) meets all of the following criteria:
3636 (i) has 100 or fewer beds;
3737 (ii) is designated by the Centers for
3838 Medicare and Medicaid Services as a critical access hospital, sole
3939 community hospital, or rural referral center; and
4040 (iii) is located in an area defined by the
4141 United States Office of Management and Budget as a metropolitan
4242 statistical area.
4343 (5) "State-owned teaching hospital" means:
4444 (A) The University of Texas Medical Branch at
4545 Galveston;
4646 (B) The University of Texas Health Science Center
4747 at Tyler; and
4848 (C) The University of Texas M.D. Anderson Cancer
4949 Center.
5050 (6) "Teaching hospital" means a hospital that incurs
5151 indirect costs for operating graduate medical education programs
5252 and for which the Centers for Medicare and Medicaid Services has
5353 calculated and assigned a percentage Medicare education adjustment
5454 factor under 42 C.F.R. Section 412.105.
5555 (7) "Urban hospital" means a hospital that:
5656 (A) is located in an area defined by the United
5757 States Office of Management and Budget as a metropolitan
5858 statistical area; and
5959 (B) is not a rural hospital, children's hospital,
6060 state-owned teaching hospital, or freestanding psychiatric
6161 facility.
6262 (b) To the extent permitted by federal law, in order to
6363 ensure that urban teaching hospitals are accurately reimbursed for
6464 the provision of inpatient hospital care to recipients under
6565 Medicaid, the commission shall, on request from a teaching
6666 hospital, update on a biannual basis the education adjustment
6767 factor used to calculate the medical education add-on using the
6868 most current Medicare education adjustment factor data available
6969 under 42 C.F.R. Section 412.105 at the time the commission makes the
7070 update.
7171 SECTION 2. If before implementing any provision of this Act
7272 a state agency determines that a waiver or authorization from a
7373 federal agency is necessary for implementation of that provision,
7474 the agency affected by the provision shall request the waiver or
7575 authorization and may delay implementing that provision until the
7676 waiver or authorization is granted.
7777 SECTION 3. This Act takes effect immediately if it receives
7878 a vote of two-thirds of all the members elected to each house, as
7979 provided by Section 39, Article III, Texas Constitution. If this
8080 Act does not receive the vote necessary for immediate effect, this
8181 Act takes effect September 1, 2021.
