8	5		AN ACT
9	6		relating to the use of information from the lists of noncitizens and
10	7		nonresidents excused or disqualified from jury service.
11	8		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	9		SECTION 1. Section 18.068(a), Election Code, is amended to
13	10		read as follows:
14	11		(a) The secretary of state shall quarterly compare the
15	12		information received under Section 16.001 of this code and Sections
16	13		[Section] 62.113 and 62.114, Government Code, to the statewide
17	14		computerized voter registration list. If the secretary determines
18	15		that a voter on the registration list is deceased or has been
19	16		excused or disqualified from jury service because the voter is not a
20	17		citizen or a resident of the county in which the voter is registered
21	18		to vote, the secretary shall send notice of the determination to:
22	19		(1) the voter registrar of the counties considered
23	20		appropriate by the secretary; and
24	21		(2) the attorney general, who shall quarterly review
25	22		the information to investigate whether a person has committed an
26	23		offense under Section 13.007 or other law.
27	24		SECTION 2. Section 62.113(b), Government Code, is amended
28	25		to read as follows:
29	26		(b) On the third business day of each month, the clerk shall
30	27		send a copy of the list of persons excused or disqualified because
31	28		of citizenship in the previous month to:
32	29		(1) the voter registrar of the county;
33	30		(2) the secretary of state; and
34		-	(3) the ~~attorney general and the~~ county or district
35		-	attorney~~[, as applicable,]~~ for an investigation of whether the
36		-	~~person~~ committed an offense under Section 13.007, Election Code, or
37		-	~~other~~ law.

	32	+	the attorney general for an investigation of whether the person

38	35		SECTION 3. Sections 62.114(b) and (c), Government Code, are
39	36		amended to read as follows:
40	37		(b) On the third business day of each month, the clerk shall
41	38		send [to the voter registrar of the county] a copy of the list of
42	39		persons excused or disqualified in the previous month because the
43	40		persons do not reside in the county to:
44	41		(1) the voter registrar of the county;
45	42		(2) the secretary of state; and
46		-	(3) the attorney general and the county or district
47		-	attorney for an investigation of whether the person committed an
48		-	offense under Section 13.007, Election Code, or other law.

49	47		(c) A list compiled under this section may not be used for a
50	48		purpose other than a purpose described by Subsection (b) or Section
51	49		15.081 or 18.068, Election Code.
52	50		SECTION 4. This Act takes effect immediately if it receives
53	51		a vote of two-thirds of all the members elected to each house, as
54	52		provided by Section 39, Article III, Texas Constitution. If this
55	53		Act does not receive the vote necessary for immediate effect, this
56	54		Act takes effect September 1, 2021.
