96 relating to the use of information from the lists of noncitizens and
107 nonresidents excused or disqualified from jury service.
118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
129 SECTION 1. Section 18.068(a), Election Code, is amended to
1310 read as follows:
1411 (a) The secretary of state shall quarterly compare the
1512 information received under Section 16.001 of this code and Sections
1613 [Section] 62.113 and 62.114, Government Code, to the statewide
1714 computerized voter registration list. If the secretary determines
1815 that a voter on the registration list is deceased or has been
1916 excused or disqualified from jury service because the voter is not a
2017 citizen or a resident of the county in which the voter is registered
2118 to vote, the secretary shall send notice of the determination to:
2219 (1) the voter registrar of the counties considered
2320 appropriate by the secretary; and
2421 (2) the attorney general, who shall quarterly review
2522 the information to investigate whether a person has committed an
2623 offense under Section 13.007 or other law.
2724 SECTION 2. Section 62.113(b), Government Code, is amended
2825 to read as follows:
2926 (b) On the third business day of each month, the clerk shall
3027 send a copy of the list of persons excused or disqualified because
3128 of citizenship in the previous month to:
3229 (1) the voter registrar of the county;
3330 (2) the secretary of state; and
34- (3) the attorney general and the county or district
35- attorney[, as applicable,] for an investigation of whether the
36- person committed an offense under Section 13.007, Election Code, or
37- other law.

32+ the attorney general for an investigation of whether the person
33+ committed an offense under Section 13.007, Election Code, or other
34+ law.
3835 SECTION 3. Sections 62.114(b) and (c), Government Code, are
3936 amended to read as follows:
4037 (b) On the third business day of each month, the clerk shall
4138 send [to the voter registrar of the county] a copy of the list of
4239 persons excused or disqualified in the previous month because the
4340 persons do not reside in the county to:
4441 (1) the voter registrar of the county;
4542 (2) the secretary of state; and
46- (3) the attorney general and the county or district
47- attorney for an investigation of whether the person committed an
48- offense under Section 13.007, Election Code, or other law.
43+ (3) the county or district attorney, as applicable, or
44+ the attorney general for an investigation of whether the person
45+ committed an offense under Section 13.007, Election Code, or other
46+ law.
4947 (c) A list compiled under this section may not be used for a
5048 purpose other than a purpose described by Subsection (b) or Section
5149 15.081 or 18.068, Election Code.
5250 SECTION 4. This Act takes effect immediately if it receives
5351 a vote of two-thirds of all the members elected to each house, as
5452 provided by Section 39, Article III, Texas Constitution. If this
5553 Act does not receive the vote necessary for immediate effect, this
5654 Act takes effect September 1, 2021.
