| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 501.138, Transportation Code, is amended |
|---|
| 10 | 10 | | to read follows: |
|---|
| 11 | 11 | | Section 501.138 (b-2) and (b-3) are repealed. |
|---|
| 12 | 12 | | SECTION 2. Section 386.250, Health and Safety Code, is |
|---|
| 13 | 13 | | hereby repealed. |
|---|
| 14 | 14 | | Section 3. Section 1.05, Chapter 1301 (H.B. 3745), Acts of |
|---|
| 15 | 15 | | the 86th Legislature, Regular Session, 2019, which amended Section |
|---|
| 16 | 16 | | 386.251, Health and Safety Code, is amended as follows: |
|---|
| 17 | 17 | | Sec. 386.251. TEXAS EMISSIONS REDUCTION PLAN ACCOUNTFUND. |
|---|
| 18 | 18 | | (a) The Texas emissions reduction plan accountfund is an account |
|---|
| 19 | 19 | | in the state treasury. |
|---|
| 20 | 20 | | (b) The accountfund is administered by the commission for |
|---|
| 21 | 21 | | the benefit of the plan established under this chapter. The account |
|---|
| 22 | 22 | | fund is exempt from the application of Section 403.095, Government |
|---|
| 23 | 23 | | Code. Interest earned on the accountfund shall be credited to the |
|---|
| 24 | 24 | | accountfund. |
|---|
| 25 | 25 | | (c) The accountfund consists of its accumulated balance and |
|---|
| 26 | 26 | | the amount of money transferred to the account under Section |
|---|
| 27 | 27 | | 386.250(c).(c). |
|---|
| 28 | 28 | | (1) the amount of money deposited to the credit of the |
|---|
| 29 | 29 | | fund under: |
|---|
| 30 | 30 | | (A) Section 386.056; |
|---|
| 31 | 31 | | (B) Sections 151.0515 and 152.0215, Tax Code; and |
|---|
| 32 | 32 | | (C) Sections 502.358, and 548.5055, |
|---|
| 33 | 33 | | Transportation Code; and |
|---|
| 34 | 34 | | (2) grant money recaptured under Section 386.111(d) |
|---|
| 35 | 35 | | and Chapter 391. |
|---|
| 36 | 36 | | SECTION 4. This ACT takes effect September 1, 2021 |
