| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Title 2, Agriculture Code, is amended by adding |
|---|
| 10 | 10 | | Chapter 23 to read as follows: |
|---|
| 11 | 11 | | CHAPTER 23. SANITARY TRANSPORTATION OF HUMAN AND ANIMAL FOOD |
|---|
| 12 | 12 | | Sec. 23.001. DEFINITION. In this chapter, "commercial |
|---|
| 13 | 13 | | motor vehicle" has the meaning assigned by Section 644.001, |
|---|
| 14 | 14 | | Transportation Code. |
|---|
| 15 | 15 | | Sec. 23.002. RULES. (a) The department by rule shall adopt |
|---|
| 16 | 16 | | standards for the sanitary transportation of human and animal food |
|---|
| 17 | 17 | | by a commercial motor vehicle. |
|---|
| 18 | 18 | | (b) Standards adopted under this section must: |
|---|
| 19 | 19 | | (1) be consistent with rules adopted by the Department |
|---|
| 20 | 20 | | of Public Safety under Section 644.055, Transportation Code; and |
|---|
| 21 | 21 | | (2) comply with the Food Safety Modernization Act (21 |
|---|
| 22 | 22 | | U.S.C. Section 2201 et seq.). |
|---|
| 23 | 23 | | Sec. 23.003. CERTIFIED CLEANING. (a) The department shall |
|---|
| 24 | 24 | | establish a certification program to ensure the uniform |
|---|
| 25 | 25 | | sanitization of commercial motor vehicles used to transport human |
|---|
| 26 | 26 | | or animal food. |
|---|
| 27 | 27 | | (b) A person certified under this section shall keep a |
|---|
| 28 | 28 | | record of each commercial motor vehicle sanitized in a form |
|---|
| 29 | 29 | | approved by the department. |
|---|
| 30 | 30 | | (c) The operator of a commercial motor vehicle used for the |
|---|
| 31 | 31 | | transportation of human or animal food shall keep with the vehicle a |
|---|
| 32 | 32 | | record of each sanitization under this section. |
|---|
| 33 | 33 | | SECTION 2. Subchapter B, Chapter 644, Transportation Code, |
|---|
| 34 | 34 | | is amended by adding Section 644.055 to read as follows: |
|---|
| 35 | 35 | | Sec. 644.055. REGULATION OF VEHICLES TRANSPORTING HUMAN OR |
|---|
| 36 | 36 | | ANIMAL FOOD. The department shall adopt rules for the inspection of |
|---|
| 37 | 37 | | a commercial motor vehicle transporting human or animal food to |
|---|
| 38 | 38 | | ensure compliance with the rules adopted by the Department of |
|---|
| 39 | 39 | | Agriculture under Section 23.002, Agriculture Code. Rules adopted |
|---|
| 40 | 40 | | under this section must be consistent with those rules. |
|---|
| 41 | 41 | | SECTION 3. (a) Not later than January 1, 2022, the Texas |
|---|
| 42 | 42 | | Department of Agriculture shall adopt rules under Chapter 23, |
|---|
| 43 | 43 | | Agriculture Code, as added by this Act. |
|---|
| 44 | 44 | | (b) Not later than January 1, 2022, the Department of Public |
|---|
| 45 | 45 | | Safety shall adopt rules under Section 644.055, Transportation |
|---|
| 46 | 46 | | Code, as added by this Act. |
|---|
| 47 | 47 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 48 | 48 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 49 | 49 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 50 | 50 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 51 | 51 | | Act takes effect September 1, 2021. |
