55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to granting limited state law enforcement authority to
88 special agents of the Office of Inspector General of the United
99 States Department of Homeland Security.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article 2.122(a), Code of Criminal Procedure, is
1212 amended to read as follows:
1313 (a) The following named criminal investigators of the
1414 United States shall not be deemed peace officers, but shall have the
1515 powers of arrest, search, and seizure under the laws of this state
1616 as to felony offenses only:
1717 (1) Special Agents of the Federal Bureau of
1818 Investigation;
1919 (2) Special Agents of the Secret Service;
2020 (3) Special Agents of the United States Immigration
2121 and Customs Enforcement;
2222 (4) Special Agents of the Bureau of Alcohol, Tobacco,
2323 Firearms and Explosives;
2424 (5) Special Agents of the United States Drug
2525 Enforcement Administration;
2626 (6) Inspectors of the United States Postal Inspection
2727 Service;
2828 (7) Special Agents of the Criminal Investigation
2929 Division of the Internal Revenue Service;
3030 (8) Civilian Special Agents of the United States Naval
3131 Criminal Investigative Service;
3232 (9) Marshals and Deputy Marshals of the United States
3333 Marshals Service;
3434 (10) Special Agents of the United States Department of
3535 State, Bureau of Diplomatic Security;
3636 (11) Special Agents of the Treasury Inspector General
3737 for Tax Administration;
3838 (12) Special Agents of the Office of Inspector General
3939 of the United States Social Security Administration;
4040 (13) Special Agents of the Office of Inspector General
4141 of the United States Department of Veterans Affairs;
4242 (14) Special Agents of the Office of Inspector General
4343 of the United States Department of Agriculture; [and]
4444 (15) Special Agents of the Office of Inspector General
4545 of the United States Department of Homeland Security; and
4646 (16) a police officer with the Office of Security and
4747 Law Enforcement of the United States Department of Veterans
4848 Affairs.
4949 SECTION 2. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect September 1, 2021.
