46 AN ACT
57 relating to examinations for applicants for or holders of licenses
68 or registrations to perform certain activities pertaining to
79 compressed natural gas or liquefied natural gas.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Sections 113.087(a), (j), and (k), Natural
1012 Resources Code, are amended to read as follows:
1113 (a) The satisfactory completion of the requirements of this
1214 section is mandatory, and operations requiring an LP-gas license
1315 may not commence, continue, or resume unless examination and
1416 seminar requirements are fulfilled. The commission shall prepare,
1517 administer, and grade or review an examination required by this
1618 section or contract with a testing or proctoring service to
1719 prepare, administer, and grade or review the examination.
1820 (j) If the examination is graded or reviewed by a testing or
1921 proctoring service:
2022 (1) the commission shall notify the person of the
2123 results of the examination not later than the 14th day after the
2224 date the commission receives the results from the testing or
2325 proctoring service; and
2426 (2) if notice of the examination results will be
2527 delayed for longer than 90 days after the examination date, the
2628 commission shall notify the person of the reason for the delay
2729 before the 90th day.
2830 (k) The commission may require a testing or proctoring
2931 service to notify a person of the results of the person's
3032 examination.
3133 SECTION 2. Section 113.088(b), Natural Resources Code, is
3234 amended to read as follows:
3335 (b) Before seminar attendance or examination of any person,
3436 except as provided by [this subsection or] Subsection (c), the
3537 commission shall receive a nonrefundable fee for each examination
3638 or seminar registration. [If the examination is administered by a
3739 testing service, the testing service may administer the examination
3840 before the commission receives the fee. A testing service that
3941 administers an examination shall collect a nonrefundable fee for
4042 the examination before the examination is administered and shall
4143 forward the fee to the commission not later than the fifth business
4244 day after the date the testing service receives the fee.]
4345 SECTION 3. Sections 116.034(e) and (f), Natural Resources
4446 Code, are amended to read as follows:
4547 (e) If the examination is graded or reviewed by a testing or
4648 proctoring service:
4749 (1) the commission shall notify the person of the
4850 results of the examination not later than the 14th day after the
4951 date the commission receives the results from the testing or
5052 proctoring service; and
5153 (2) if notice of the examination results will be
5254 delayed for longer than 90 days after the examination date, the
5355 commission shall notify the person of the reason for the delay
5456 before the 90th day.
5557 (f) The commission may require a testing or proctoring
5658 service to notify a person of the results of the person's
5759 examination.
5860 SECTION 4. This Act takes effect September 1, 2021.
