5	7		relating to examinations for applicants for or holders of licenses
6	8		or registrations to perform certain activities pertaining to
7	9		compressed natural gas or liquefied natural gas.
8	10		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	11		SECTION 1. Sections 113.087(a), (j), and (k), Natural
10	12		Resources Code, are amended to read as follows:
11	13		(a) The satisfactory completion of the requirements of this
12	14		section is mandatory, and operations requiring an LP-gas license
13	15		may not commence, continue, or resume unless examination and
14	16		seminar requirements are fulfilled. The commission shall prepare,
15	17		administer, and grade or review an examination required by this
16	18		section or contract with a testing or proctoring service to
17	19		prepare, administer, and grade or review the examination.
18	20		(j) If the examination is graded or reviewed by a testing or
19	21		proctoring service:
20	22		(1) the commission shall notify the person of the
21	23		results of the examination not later than the 14th day after the
22	24		date the commission receives the results from the testing or
23	25		proctoring service; and
24	26		(2) if notice of the examination results will be
25	27		delayed for longer than 90 days after the examination date, the
26	28		commission shall notify the person of the reason for the delay
27	29		before the 90th day.
28	30		(k) The commission may require a testing or proctoring
29	31		service to notify a person of the results of the person's
30	32		examination.
31	33		SECTION 2. Section 113.088(b), Natural Resources Code, is
32	34		amended to read as follows:
33	35		(b) Before seminar attendance or examination of any person,
34	36		except as provided by [this subsection or] Subsection (c), the
35	37		commission shall receive a nonrefundable fee for each examination
36	38		or seminar registration. [If the examination is administered by a
37	39		testing service, the testing service may administer the examination
38	40		before the commission receives the fee. A testing service that
39	41		administers an examination shall collect a nonrefundable fee for
40	42		the examination before the examination is administered and shall
41	43		forward the fee to the commission not later than the fifth business
42	44		day after the date the testing service receives the fee.]
43	45		SECTION 3. Sections 116.034(e) and (f), Natural Resources
44	46		Code, are amended to read as follows:
45	47		(e) If the examination is graded or reviewed by a testing or
46	48		proctoring service:
47	49		(1) the commission shall notify the person of the
48	50		results of the examination not later than the 14th day after the
49	51		date the commission receives the results from the testing or
50	52		proctoring service; and
51	53		(2) if notice of the examination results will be
52	54		delayed for longer than 90 days after the examination date, the
53	55		commission shall notify the person of the reason for the delay
54	56		before the 90th day.
55	57		(f) The commission may require a testing or proctoring
56	58		service to notify a person of the results of the person's
57	59		examination.
58	60		SECTION 4. This Act takes effect September 1, 2021.
