5	5	A BILL TO BE ENTITLED
6	6	AN ACT
7	7	relating to the membership of a school district's threat assessment
8	8	and safe and supportive school team and committee and the school
9	9	safety allotment under the public school finance system.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Section 37.108(b-1), Education Code, is amended
12	12	to read as follows:
13	13	(b-1) In a school district's safety and security audit
14	14	required under Subsection (b), the district must certify that the
15	15	district used the funds provided to the district through the school
16	16	safety allotment under Section 48.115 [42.168] only for the
17	17	purposes provided by that section.
18	18	SECTION 2. Sections 37.115(d) and (e), Education Code, are
19	19	amended to read as follows:
20	20	(d) The superintendent of the district shall ensure that the
21	21	members appointed to each team have expertise in counseling,
22	22	behavior management, mental health and substance use, classroom
23	23	instruction, special education, school administration, school
24	24	safety and security, and emergency management[, and law
25	25	enforcement]. A team may serve more than one campus of a school
26	26	district, provided that each district campus is assigned a team.
27	27	(e) The superintendent of a school district may establish a
28	28	committee, or assign to an existing committee established by the
29	29	district, the duty to oversee the operations of teams established
30	30	for the district. A committee with oversight responsibility under
31	31	this subsection must include members with expertise in human
32	32	resources, education, special education, counseling, behavior
33	33	management, school administration, mental health and substance
34	34	use, school safety and security, and emergency management[, and law
35	35	enforcement].
36	36	SECTION 3. Section 42.168, Education Code, as added by
37	37	Chapter 464 (S.B. 11), Acts of the 86th Legislature, Regular
38	38	Session, 2019, is transferred to Subchapter C, Chapter 48,
39	39	Education Code, redesignated as Section 48.115, Education Code,
40	40	amended to conform to changes made by Chapter 943 (H.B. 3), Acts of
41	41	the 86th Legislature, Regular Session, 2019, and further amended to
42	42	read as follows:
43	43	Sec. 48.115 [42.168]. SCHOOL SAFETY ALLOTMENT. (a) From
44	44	funds appropriated for that purpose, the commissioner shall provide
45	45	to a school district an annual allotment in the amount provided by
46	46	appropriation for each student in average daily attendance.
47	47	(b) Funds allocated under this section must be used to
48	48	improve school safety and security, including costs associated
49	49	with:
50	50	(1) securing school facilities, including:
51	51	(A) improvements to school infrastructure;
52	52	(B) the use or installation of physical barriers;
53	53	and
54	54	(C) the purchase and maintenance of:
55	55	(i) security cameras or other security
56	56	equipment; and
57	57	(ii) technology, including communications
58	58	systems or devices, that facilitates communication and information
59	59	sharing between students, school personnel, and first responders in
60	60	an emergency;
61	61	(2) [providing security for the district, including:
62	62	[(A) employing school district peace officers,
63	63	private security officers, and school marshals; and
64	64	[(B) collaborating with local law enforcement
65	65	agencies, such as entering into a memorandum of understanding for
66	66	the assignment of school resource officers to schools in the
67	67	district;
68	68	[(3)] school safety and security training and
69	69	planning, including:
70	70	(A) active shooter and emergency response
71	71	training;
72	72	(B) prevention and treatment programs relating
73	73	to addressing adverse childhood experiences; and
74	74	(C) the prevention, identification, and
75	75	management of emergencies and threats, using evidence-based,
76	76	effective prevention practices and including:
77	77	(i) providing licensed counselors, social
78	78	workers, social-emotional learning coordinators, and individuals
79	79	trained in restorative discipline and restorative justice
80	80	practices;
81	81	(ii) providing mental health personnel and
82	82	support;
83	83	(iii) [(ii)] providing behavioral health
84	84	services; [and]
85	85	(iv) [(iii)] establishing threat reporting
86	86	systems; and
87	87	(v) developing and implementing programs
88	88	focused on social-emotional learning, restorative justice
89	89	practices, culturally relevant instruction, and providing mental
90	90	health support; and
91	91	(3) [(4)] providing programs related to suicide
92	92	prevention, intervention, and postvention.
93	93	(c) A school district may use funds allocated under this
94	94	section for equipment or software that is used for a school safety
95	95	and security purpose and an instructional purpose, provided that
96	96	the instructional use does not compromise the safety and security
97	97	purpose of the equipment or software.
98	98	(d) The commissioner shall annually publish a report
99	99	regarding funds allocated under this section including the
100	100	programs, personnel, and resources purchased by districts using
101	101	funds under this section and other purposes for which the funds were
102	102	used [A school district that is required to take action under
103	103	Chapter 41 to reduce its wealth per student to the equalized wealth
104	104	level is entitled to a credit, in the amount of the allotments to
105	105	which the district is to receive as provided by appropriation,
106	106	against the total amount required under Section 41.093 for the
107	107	district to purchase attendance credits].
108	108	[(e) The commissioner may adopt rules to implement this
109	109	section.]
110	110	SECTION 4. To the extent of any conflict, this Act prevails
111	111	over another Act of the 87th Legislature, Regular Session, 2021,
112	112	relating to nonsubstantive additions to and corrections in enacted
113	113	codes.
114	114	SECTION 5. This Act takes effect September 1, 2021.
