55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the regional inventory of mental health resources for
88 public schools and the statewide plan for student mental health.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 38.252(a) and (b), Education Code, are
1111 amended to read as follows:
1212 (a) Each regional education service center shall use the
1313 rubric developed under Section 38.251 to identify resources related
1414 to student mental health available to schools in the center's
1515 region, including trainings and evidence-based and promising
1616 programs and best practices, that:
1717 (1) create school environments that support the
1818 social, emotional, and academic development of students, including
1919 through the use of trauma-informed practices;
2020 (2) identify students who may need additional
2121 behavioral or mental health support before issues arise;
2222 (3) provide early, effective interventions to
2323 students in need of additional support;
2424 (4) connect students and their families to specialized
2525 services in the school or community when needed; and
2626 (5) assist schools in aligning resources necessary to
2727 address the mental health of students.
2828 (b) In identifying resources under Subsection (a), a [A]
2929 regional education service center shall consult with a
3030 non-physician mental health professional described by Section
3131 8.153 and may consult with any entity the center considers
3232 necessary [in identifying resources under Subsection (a)],
3333 including:
3434 (1) school districts;
3535 (2) local mental health authorities;
3636 (3) community mental health services providers;
3737 (4) education groups;
3838 (5) hospitals; and
3939 (6) institutions of higher education.
4040 SECTION 2. Section 38.254, Education Code, is amended by
4141 adding Subsection (b-1) and amending Subsection (d) to read as
4242 follows:
4343 (b-1) In developing the agency's goals under Subsection
4444 (a)(4) or the agency's recommendations under Subsection (a)(6) for
4545 a year before 2026, the agency shall consult with the Collaborative
4646 Task Force on Public School Mental Health Services established
4747 under Section 38.302 in addition to the persons the agency is
4848 required to consult with under Subsection (b). This subsection
4949 expires December 1, 2025.
5050 (d) As soon as practicable after completing or revising the
5151 plan, the agency shall:
5252 (1) submit an electronic copy of the plan to:
5353 (A) the legislature; and
5454 (B) the statewide behavioral health coordinating
5555 council established under Subchapter M-1, Chapter 531, Government
5656 Code;
5757 (2) post the plan on the agency's Internet website; and
5858 (3) hold public meetings in each regional education
5959 service center's region to present the statewide plan and shall
6060 provide an opportunity for public comment at each meeting.
6161 SECTION 3. This Act applies beginning with the 2021-2022
6262 school year.
6363 SECTION 4. This Act takes effect immediately if it receives
6464 a vote of two-thirds of all the members elected to each house, as
6565 provided by Section 39, Article III, Texas Constitution. If this
6666 Act does not receive the vote necessary for immediate effect, this
6767 Act takes effect September 1, 2021.
