66 AN ACT
77 relating to in-depth evaluations and reports on certain investments
88 of the Teacher Retirement System of Texas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 801, Government Code, is
1111 amended by adding Section 801.2035 to read as follows:
1212 Sec. 801.2035. IN-DEPTH EVALUATION AND LEGISLATIVE REPORT
1313 ON CERTAIN TEACHER RETIREMENT SYSTEM OF TEXAS INVESTMENTS. (a) In
1414 this section, "retirement system" means the Teacher Retirement
1515 System of Texas.
1616 (b) On request and at the direction of the legislative
1717 committees in either or both houses of the legislature with primary
1818 jurisdiction over public retirement systems, the board shall:
1919 (1) conduct an in-depth evaluation of specific
2020 securities in which any assets of the Teacher Retirement System of
2121 Texas are invested, including any interest held by the retirement
2222 system in a limited partnership or investment contract, that either
2323 or both committees determine appropriate for further evaluation
2424 under this section; and
2525 (2) submit a report, including confidential
2626 information as directed, to the requesting committee or committees,
2727 as applicable, of the evaluation completed by the board under
2828 Subdivision (1).
2929 (c) The governing body of the retirement system shall
3030 provide the information requested under this section, including
3131 confidential information as directed, as soon as practicable after
3232 receiving the request. The board shall prescribe the form and
3333 manner by which the information must be submitted to the board.
3434 (d) A disclosure of information under this section to the
3535 board does not waive or affect the confidentiality of the
3636 information for purposes of state or federal law or waive the right
3737 to assert exceptions to required disclosure of the information in
3838 the future.
3939 (e) The governing body of the retirement system may require
4040 the individual requesting the information on behalf of the board,
4141 the requesting legislative committee or committees, as applicable,
4242 and the members or employees of the board and legislative committee
4343 or committees, as applicable, who will view or handle information
4444 that is received under this section and that is confidential under
4545 law to sign a confidentiality agreement that covers the agreement
4646 and requires that:
4747 (1) the information not be disclosed outside the board
4848 and requesting legislative committee or committees, as applicable,
4949 or within the board and committee or committees, as applicable, for
5050 purposes other than the purpose for which it was received;
5151 (2) the information be labeled as confidential;
5252 (3) the information be kept securely; or
5353 (4) the number of copies made of the information or the
5454 notes taken from the information that implicate the confidential
5555 nature of the information be controlled, with all copies or notes
5656 that are not destroyed or returned to the retirement system
5757 remaining confidential and subject to the confidentiality
5858 agreement.
5959 (f) An evaluation or report prepared under this section is
6060 not subject to disclosure under Chapter 552.
6161 SECTION 2. This Act takes effect September 1, 2021.
