| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 51.942, Education Code, is amended by | |
| 12 | 12 | adding Subsection (c-1) to read as follows: | |
| 13 | 13 | (c-1) For purposes of Subsection (c)(5), good cause for | |
| 14 | 14 | revoking the tenure of or otherwise disciplining a faculty member | |
| 15 | 15 | includes the faculty member's initiation of a civil suit against a | |
| 16 | 16 | student enrolled at the institution, regardless of whether the | |
| 17 | 17 | claim is subsequently litigated or dismissed. | |
| 18 | 18 | SECTION 2. This Act takes effect immediately if it receives | |
| 19 | 19 | a vote of two-thirds of all the members elected to each house, as | |
| 20 | 20 | provided by Section 39, Article III, Texas Constitution. If this | |
| 21 | 21 | Act does not receive the vote necessary for immediate effect, this | |
| 22 | 22 | Act takes effect September 1, 2021. |
