55 AN ACT
66 relating to the university advisory committee of and procedure for
77 making awards by the Cancer Prevention and Research Institute of
88 Texas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 102.154(a), Health and Safety Code, is
1111 amended to read as follows:
1212 (a) The Cancer Prevention and Research Institute of Texas
1313 University Advisory Committee is composed of the following members:
1414 (1) two members appointed by the chancellor of The
1515 University of Texas System to represent:
1616 (A) The University of Texas Southwestern Medical
1717 Center;
1818 (B) The University of Texas Medical Branch at
1919 Galveston;
2020 (C) The University of Texas Health Science Center
2121 at Houston;
2222 (D) The University of Texas Health Science Center
2323 at San Antonio;
2424 (E) The University of Texas Health Center at
2525 Tyler; [or]
2626 (F) The University of Texas Rio Grande Valley
2727 School of Medicine; or
2828 (G) The University of Texas M. D. Anderson Cancer
2929 Center;
3030 (2) one member appointed by the chancellor of The
3131 Texas A&M University System to represent:
3232 (A) The Texas A&M University System Health
3333 Science Center; or
3434 (B) the teaching hospital for The Texas A&M
3535 Health Science Center College of Medicine;
3636 (3) one member appointed by the chancellor of the
3737 Texas Tech University System to represent the Texas Tech University
3838 Health Sciences Center;
3939 (4) one member appointed by the chancellor of the
4040 University of Houston System to represent the system;
4141 (5) one member appointed by the chancellor of the
4242 Texas State University System to represent the system;
4343 (6) one member appointed by the chancellor of the
4444 University of North Texas System to represent the system;
4545 (7) one member appointed by the president of Baylor
4646 College of Medicine;
4747 (8) one member appointed by the president of Rice
4848 University;
4949 (9) members appointed at the executive director's
5050 discretion by the chancellors of other institutions.
5151 SECTION 2. Section 102.251, Health and Safety Code, is
5252 amended by adding Subsections (f) and (g) to read as follows:
5353 (f) The oversight committee may request a list of all grant
5454 applications submitted to the institute under this chapter,
5555 regardless of whether the grant applications were included on the
5656 list submitted to the committee under Subsection (a)(2).
5757 (g) The institute shall allocate grant money awarded under
5858 Subchapter E in a fiscal year to projects located in counties that:
5959 (1) have been designated under state or federal law as
6060 a medically underserved area;
6161 (2) contain a health-related institution of higher
6262 education whose expenditures for research and development in the
6363 previous year was not in the top three among health-related
6464 institutions; and
6565 (3) contain a hospital.
6666 (h) Grant money awarded under subsection (g) for cancer
6767 prevention and research purposes may only be used for cancer
6868 prevention programming and operations.
6969 SECTION 3. Section 102.252, Health and Safety Code, is
7070 amended to read as follows:
7171 Sec. 102.252. FUNDING RECOMMENDATIONS. (a) Two-thirds of
7272 the members of the oversight committee present and voting must vote
7373 to approve each funding recommendation of the program integration
7474 committee. If the oversight committee does not approve a funding
7575 recommendation of the program integration committee, a statement
7676 explaining the reasons a funding recommendation was not followed
7777 must be included in the minutes of the meeting.
7878 (b) The oversight committee may vote on a grant application
7979 included on a list requested by the oversight committee under
8080 Section 102.251(f). Two-thirds of the members of the oversight
8181 committee present and voting must vote to approve each grant
8282 application. If the oversight committee does not approve a grant
8383 application, a statement explaining the reasons grant money will
8484 not be awarded to the applicant must be included in the minutes of
8585 the meeting.
8686 SECTION 4. Section 102.255, Health and Safety Code, is
8787 amended by adding Subsection (b-1) to read as follows:
8888 (b-1) If the institute recovers money under Subsection
8989 (b)(2) or (3), the institute may award that money during the same
9090 grant cycle in accordance with this chapter to a project that the
9191 institute determines is able to be imminently commenced.
9292 SECTION 5. (a) As soon as practicable after the effective
9393 date of this Act, the Cancer Prevention and Research Institute of
9494 Texas Oversight Committee shall adopt the rules necessary to
9595 implement the changes in law made by this Act.
9696 (b) The changes in law made by this Act apply only to a grant
9797 application submitted to the Cancer Prevention and Research
9898 Institute of Texas on or after the effective date of this Act. A
9999 grant application submitted before the effective date of this Act
100100 is governed by the law in effect on the date the application was
101101 submitted, and that law is continued in effect for that purpose.
102102 SECTION 6. This Act takes effect September 1, 2021.
