5	5	AN ACT
6	6	relating to the university advisory committee of and procedure for
7	7	making awards by the Cancer Prevention and Research Institute of
8	8	Texas.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 102.154(a), Health and Safety Code, is
11	11	amended to read as follows:
12	12	(a) The Cancer Prevention and Research Institute of Texas
13	13	University Advisory Committee is composed of the following members:
14	14	(1) two members appointed by the chancellor of The
15	15	University of Texas System to represent:
16	16	(A) The University of Texas Southwestern Medical
17	17	Center;
18	18	(B) The University of Texas Medical Branch at
19	19	Galveston;
20	20	(C) The University of Texas Health Science Center
21	21	at Houston;
22	22	(D) The University of Texas Health Science Center
23	23	at San Antonio;
24	24	(E) The University of Texas Health Center at
25	25	Tyler; [or]
26	26	(F) The University of Texas Rio Grande Valley
27	27	School of Medicine; or
28	28	(G) The University of Texas M. D. Anderson Cancer
29	29	Center;
30	30	(2) one member appointed by the chancellor of The
31	31	Texas A&M University System to represent:
32	32	(A) The Texas A&M University System Health
33	33	Science Center; or
34	34	(B) the teaching hospital for The Texas A&M
35	35	Health Science Center College of Medicine;
36	36	(3) one member appointed by the chancellor of the
37	37	Texas Tech University System to represent the Texas Tech University
38	38	Health Sciences Center;
39	39	(4) one member appointed by the chancellor of the
40	40	University of Houston System to represent the system;
41	41	(5) one member appointed by the chancellor of the
42	42	Texas State University System to represent the system;
43	43	(6) one member appointed by the chancellor of the
44	44	University of North Texas System to represent the system;
45	45	(7) one member appointed by the president of Baylor
46	46	College of Medicine;
47	47	(8) one member appointed by the president of Rice
48	48	University;
49	49	(9) members appointed at the executive director's
50	50	discretion by the chancellors of other institutions.
51	51	SECTION 2. Section 102.251, Health and Safety Code, is
52	52	amended by adding Subsections (f) and (g) to read as follows:
53	53	(f) The oversight committee may request a list of all grant
54	54	applications submitted to the institute under this chapter,
55	55	regardless of whether the grant applications were included on the
56	56	list submitted to the committee under Subsection (a)(2).
57	57	(g) The institute shall allocate grant money awarded under
58	58	Subchapter E in a fiscal year to projects located in counties that:
59	59	(1) have been designated under state or federal law as
60	60	a medically underserved area;
61	61	(2) contain a health-related institution of higher
62	62	education whose expenditures for research and development in the
63	63	previous year was not in the top three among health-related
64	64	institutions; and
65	65	(3) contain a hospital.
66	66	(h) Grant money awarded under subsection (g) for cancer
67	67	prevention and research purposes may only be used for cancer
68	68	prevention programming and operations.
69	69	SECTION 3. Section 102.252, Health and Safety Code, is
70	70	amended to read as follows:
71	71	Sec. 102.252. FUNDING RECOMMENDATIONS. (a) Two-thirds of
72	72	the members of the oversight committee present and voting must vote
73	73	to approve each funding recommendation of the program integration
74	74	committee. If the oversight committee does not approve a funding
75	75	recommendation of the program integration committee, a statement
76	76	explaining the reasons a funding recommendation was not followed
77	77	must be included in the minutes of the meeting.
78	78	(b) The oversight committee may vote on a grant application
79	79	included on a list requested by the oversight committee under
80	80	Section 102.251(f). Two-thirds of the members of the oversight
81	81	committee present and voting must vote to approve each grant
82	82	application. If the oversight committee does not approve a grant
83	83	application, a statement explaining the reasons grant money will
84	84	not be awarded to the applicant must be included in the minutes of
85	85	the meeting.
86	86	SECTION 4. Section 102.255, Health and Safety Code, is
87	87	amended by adding Subsection (b-1) to read as follows:
88	88	(b-1) If the institute recovers money under Subsection
89	89	(b)(2) or (3), the institute may award that money during the same
90	90	grant cycle in accordance with this chapter to a project that the
91	91	institute determines is able to be imminently commenced.
92	92	SECTION 5. (a) As soon as practicable after the effective
93	93	date of this Act, the Cancer Prevention and Research Institute of
94	94	Texas Oversight Committee shall adopt the rules necessary to
95	95	implement the changes in law made by this Act.
96	96	(b) The changes in law made by this Act apply only to a grant
97	97	application submitted to the Cancer Prevention and Research
98	98	Institute of Texas on or after the effective date of this Act. A
99	99	grant application submitted before the effective date of this Act
100	100	is governed by the law in effect on the date the application was
101	101	submitted, and that law is continued in effect for that purpose.
102	102	SECTION 6. This Act takes effect September 1, 2021.
