9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 211.007, Local Government Code, is | |
11 | 11 | amended by adding Subsection (c-3) to read as follows: | |
12 | 12 | (c-3) A zoning commission must give written notice of a | |
13 | 13 | public hearing before the commission on a proposed change in zoning | |
14 | 14 | classification to each owner of real property that is wholly or | |
15 | 15 | partly located in an unincorporated area of a county if the nearest | |
16 | 16 | property line of the property is located not more than two miles | |
17 | 17 | from the nearest boundary of the area for which the zoning | |
18 | 18 | classification change is proposed. The commission must provide the | |
19 | 19 | notice: | |
20 | 20 | (1) not later than the 10th day before the date of the | |
21 | 21 | hearing; and | |
22 | 22 | (2) by United States mail, addressed to each owner of | |
23 | 23 | the property, as indicated on the most recently approved county tax | |
24 | 24 | roll. | |
25 | 25 | SECTION 2. The changes in law made by this Act apply only to | |
26 | 26 | a proposal to change a municipal zoning classification made on or | |
27 | 27 | after the effective date of this Act. | |
28 | 28 | SECTION 3. This Act takes effect September 1, 2021. |
