66 AN ACT
77 relating to notice of proposed changes to municipal zoning
88 classifications.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 211.007, Local Government Code, is
1111 amended by adding Subsection (c-3) to read as follows:
1212 (c-3) A zoning commission must give written notice of a
1313 public hearing before the commission on a proposed change in zoning
1414 classification to each owner of real property that is wholly or
1515 partly located in an unincorporated area of a county if the nearest
1616 property line of the property is located not more than two miles
1717 from the nearest boundary of the area for which the zoning
1818 classification change is proposed. The commission must provide the
1919 notice:
2020 (1) not later than the 10th day before the date of the
2121 hearing; and
2222 (2) by United States mail, addressed to each owner of
2323 the property, as indicated on the most recently approved county tax
2424 roll.
2525 SECTION 2. The changes in law made by this Act apply only to
2626 a proposal to change a municipal zoning classification made on or
2727 after the effective date of this Act.
2828 SECTION 3. This Act takes effect September 1, 2021.
